;. Section 1. The Mayor and City Clerk are hereby authorized and directed to execute
3 an amendment to the agreement with Bums & McDonnell for Consultant Services for
Design of West Edgewood Drive.
` Section 2. The agreement shall be substantially the same in form and content as

AMNDMENT TO CONTRACT FOR ENGINEERING
SERVICES
WHEREAS, the City of Jefferson, Missouri, a municipal corporation hereinafter designated.
"City", entered into an Agreement with Burns &McDonnell, hereinafter refe.axe�l to as"Engi ,
on April 16, 1991;
WHEREAS, the Agreement was for certain technical rofp a
Exhibit A, which was attached to the Contract dated April G, 1991,�inconnection with a Frog
Hollow Belt System;and
WHEREAS, the parties wish to amend Exhibit"A"to the Contract dated April 16, 1991,
entitled"Scope of Engineering Services for Frog Hollow Belt System,"to include tfie Scope of
Engineering Services set out in the attached revised Exhibit'A" which is made a part hereof by
reference;which reflects the additional work requirements to: (1)revise the roadway profile grade
between stations 32+00 to 51+00; (2)provide technical support t ;
alternatives in conformance with U.S.Army Corps of Engineers 40 bepermit proc s; (3')'

roadway plans as required by the 404b permit and as directed by the City; and )
"( WHEREAS, the parties with to amend the Contract of April 16, '991, to incxease the
contract amount as this change is necessitated by additional work requirements to: (1.)revise the
roadway profile grade between stations 32+00 to 2 51+00.

preparation of alternative alternatives in conformance with U.S.Army Corpa of Engineers 404b
Permit process;(3)revise the roadway plans as required by the 404b permit and as directed by the ;r

WHEREAS, the parties wish to extend the contract period for completion of the reprised
roadway plans a total of six weeks from the City's notification to proceed with final pl>?,n revisions
based on an approved alternative revised alignment. f'

NOW, THEREFORE, be it agreed as follows: �!
1. The parties hereby agree to amend Exhibit"A" to the Contract dated April 16, 1991,
concerning the scope of services entitled"Scope of Engineering Services for Frog Hollow Belt
j System," to include the engineering services set out in the attached revised Exhibit"A,"which is
( made a part hereof by reference, which is necessitated by the additional work requirements.
2. Subparagraph"a"of paragraph 6, entitled"Compensation,"is hereby amended to read as '
' follows:
a. For the services outlined in Paragraph 1 - SCOPE OF SERVICES, he City agrees to pay
the Engineer a fee computed on the basis of(1) hourly rates indicated in,the rata sheet
BMR798 (attached herein as Exhibit B and made part of this Agreement),such rates
include base salary cost, direct payroll additives, general administrativee overhead and
profit,and(2)reimbursable direct expenses. The term "base sal '
actual amounts paid employees of the Engineer, � cost'"shall the

on each employee's hourly rate. Base salary cost does not include direct payroll additives,
general and administrative overhead and profit. The term "directive payroll additives"

general expense. .The maximum compensation encumbered under this Agreements shijl
h be Four Hundred Three Thousand, One Hundred Fifty Six Dollars($403,156.00).
3. It is hereby agreed to by the parties that the contract period be extended to provide for
final plans completed sic weeks from receipt of offsite development plans,or notification to proceed
,-with final plan revisions based on an approved alternative revised alignment, whichever occurs
dater.
4. All other sections of the Contract dated April 16, 1991, as previously amended, shall

RE,VISED SCOPE OF SERVICES
FOR i
FROG FOLLOW BELT SYSTEM
JUNE 4, 1999
The revised scope of services shall include those listed in Exhibit A in the previous contract amendment
dated October 26, 1998,and shall also include the following:
1. Revise the profile grade design of the west end of Edgewood Drive from station 32 -00 to station j
51+00 as directed by the City to facilitate right-of-way negotiations and reduce off-site borrow s
requirements. The Modifications shall include the following design revisions.: '
a. Modify the vertical alignment to lower profile grade approximately five feet in the vicinity
of station 41+00.
b. Modify the cross-sections.
c. Review stormwater design criteria and revise storm drainage design.
d. Modify the sanitary sewer design.
e. Revise quantities and estimates.
2. Provide technical support and coordination for preparation of U.S.Army Corps of Engineers 4434b
permit for construction in Weirs Creek. Develop 7 alignment alternatives to minimize or avoid
impacts to Weirs Creek as directed by the City to address U.S. Army Corps of Engineers 404
permitting concerns. Each alternative to include a narrative description of relative impacts to Weirs
Creek due to channelization and roadway construction. E
a. Alternative 1 -An avoidance alternative alignment of Edgewood Drive that does not require any
channel changes or culverts along the existing Weirs Creek alignment,generally involving a total
relocation of Edgewood Drive to the north including a portion of the segment of Phase I
previously constructed east of Wildwood Drive.
b. Alternative 2 -An alternative alignment of Edgewood Drive that avoids any channel changes on
the west end of Weirs Creek but includes channel changes on the east end.
c. Alternative 3 - An alternative alignment of Edgewood Drive that avoid any channel changes on
the west end of Weirs Creek and utilizes culverts to minimize channel changes on the east end.
d. Alternative 3a-An alternative alignment of Edgewood Drive that shifts the alignment
approximately 50 feet north of the existing alignment west of Harper"s Ferry Road and utilizes
" low flow culverts and overflow channels at the oxbow at approximately tation 69+00.

e. Alternative 4 -An alternative that utilizes the currently designed alignment with additional
skewed roadway crossing culverts along the existing alignment of Weirs Creek to minimize the
> amount of required channel change.

a. Develop conceptual horizontal geometries for each alternative.
b. Perform conceptual drainage design for all major drainage features af'f'ected by each of the
alternatives.
c. Prepare approximate cost estimates for each of the alternatives.
d. Develop mitigation plans required for each of the alternatives.
e. Develop a cost-benefit comparison of the 5 alternatives and participate in tho recommendation of
the preferred alternative.
{ 5. Revise the final roadway plans for Edgewood Drive, based on approved alternative as directed by
the City.

7. Coordinate the final design of Edgewood Drive with the revisions to proposed adjacent development
plans. Coordinate revisions to right of way and easement acquisition documents based on modified ;
roadway design with others.
;. g. Estimated fee for the outlined scope of services is based on the following assumptions:
a. Alternative concepts will be prepared based on uncontrolled photographic topographic mapping
provided by the City.
b. Consultant will participate in three meetings to coordinate plan revisions and 404 permit
application.
c. City to provide modified adjacent development plans including final entrance locations and
offsite grading plans for inclusion in the final plans. '
i d. Preparation of revised acquisition plats for easement and right of way will be the responsibilities

AMENDMENT TO CONTRACT FOR E ,NOINEERINO SERVICES
WHEREAS, the City of Jefferson, Missouri, a municipal corporation, hereinafter referred to as "City,"
entered into a Contract with Burns & McDonnell Engineering Company, Inc., hereinafter referred to as
"Engineer," on April 16, 1991; and
1 WHEREAS, the Contract was for certain technical professional services described in Exhibit A to the
Contract in connection with the Frog Hollow Belt System; and
WHEREAS, the parties wish to amend Exhibit A to the Contract dated April 16, 1991, entitled"Scope of
Engineering Services for Frog Hollow Belt System," to include the Scope of Engineering Services set out in
the attached revised Exhibit A, which is made a part hereof by reference; which reflects the additional.work !
requirements to incorporate current development plans and an expanded project scope after the ninety
percent (90%) complete plans were completed and submitted in 1996; and

WHEREAS,the parties wish to amend the Contract of April 16, 1991, to increase the contrast amount as
this change is necessitated by additional work requirements to incorporate current development plans and.
an expanded project scope after the ninety percent(90%) complete plans Nvere completed and submitted in
1.996; and
WHEREAS, the parties wish to extend the contract period for completion of the project.
NOW, THEREFORE, be it agreed as follows:
q A. The parties hereby agree to amend Exhibit A to the Contract dated A I ril 16, 1991, concerning the
scope of services entitled "Scope of Engineering Services for Frog Hollow Belt System," to include
the engineering services set out in the attached revised Exhibit A, which is made a hart hereof by

reference, which is necessitated by the additional work requirements to incorporate current
i development plans and an expanded project scope after the niriety percent (90%) complete plans

B. Paragraph 6, entitled"Compensation,"to the Contract of April 16, 1991, is hereby amended to read
as follows:

6. Com ern tea ion. The City will pay the Engineer in accordance with the
j rate set forth below, which shall constitute full and complete compensation for the
Engineer services hereunder. Such compensation will be paid in progress payments,
as established by the City. The final payment will be subject to receipt of a requisition
ffor payment and a statement of services rendered from the Engineer that the Engineer
1 fully performed with work to be paid for in progress payments in conformance with the
Contract. It is expressly understood that in no event will the total compensation and
j reimbursement to be paid to the Engineer under the terms of this Contract exceed the
sum of Three Hundred Forty-Three Thousand Five Hundred Seventy-Nine Dollars
($343,579.130) for all services required unless specifically and mutually agreed to in
writing by both the City and Engineer. No change shall be made unless there is a
substantial and significant difference between the work originally contemplated by
this agreement and the work actually required.

For the services covered by this Contract-, the City agrees to pay the Engineer

Hundred Seventy-Nine Dollars($343,579.00).
b. Reimbursable direct expenses chargeable to the project, which are
included in the maximum fee billing above, are as follows:
(I) Travel, subsistence,and incidental costs.
(2) Use of motor vehicles on a mileage or rental basis.
(3) Telephone and telegraph costs.
(4) Reproduction p n of project documents.
(5) Postage and shipping charges for project related materials. '
(6) Rental charges for use of equipment, including equipment !j
owned by the Engineer, not included in overhead costs.
C. Partial eriodic monthly y payments shall be made to the Engineer by
the City as follows:
(1) The Engineer shall render an itemized monthly statement to
the City for work performed and costs incurred during the
preceding month.
(2) The monthly installments and current total billings shall not ! i
be disproportionate to work progress as reported by the
Engineer. f.
(3) The entire amount due shall be paid each month provided
the maximum billing amount has not been exceeded.

d. All compensation and billings will be at the rates in Exhibit B. 4
# C. It is hereby agreed to by the parties that the contract period be extended to provide for final plane

' The revised scope of services shall include those listed in Exhibit A in the previous contract amendment

dated July 24, 1995, and shall also include the following:
? 1. Retrieve and reactivate most current roadway drawings and design files and review status relating
to unresolved issues and remaining project design tasks. Participate in project status review
meeting and collect current development plans.
2. Review most current development plans for the Kaufman and. Chamber of Commerce properties
relating to overall impacts to right-of-way and current design of Edgewood Drive, Phase 2, between
Wildwood and Fairground. Specific stormwater provision included in current development plans

to be incorporated into the Edgewood Drive design include:

a. Proposed stormwater detention basis between stations 32+00 and 41+00, left.
°3 b. Proposed channel modifications and new culvert crossing at station 51a+-00.
C. Proposed channel modifications and culvert crossing at station 59+25 to replace currently
design skewed culvert .
3. Prepare hydraulic and hydrologic evaluation of new roadway culverts and storm drainage system

4. Incorporate proposed grading plan at the CC Lot 6 pad site between stations 60+00 and 65+00, rigiat
into the roadway plans.
5. Coordinate and include design ofHarper's Ferry Road connection with provisions for drainage at the
intersection.
6. Incorporate recommended roadway geometries at Wildwood Drive/Edgewood intersection curren6y
under design in conjunction with the traffic signal design at the intersection. Engineer will
coordinate roadway geometries with design consultant for traffic signal design. "
7. Investigate and incorporate alternative bikeway locations at the eastern and western ;project
termini.
8. Extend roadway lighting for entire limits of the roadway project. Coordinate roadway lighting
i,.. design with Union Electric overhead power relocations.
' 9. Organize and conduct general utilities coordination meeting and incorporate current utilities

relocations and improvements to support the roadway construction and planned development.
