ELECTION TO APPROVE THE EXTENSION OF THE CITY LIMITS THROUGH
ANNEXATION.

WHEREAS, a public hearing concerning the annexation of certain real estate to the
City of Jefferson, Missouri, was held, and a "Plan of Intent" and evidence in support thereof
was presented; and
WHEREAS,the City Council of the City of Jefferson, Missouri,:,adopted Resolution No.
RS96-27 on March 17, 1997, to annex an unincorporated area of land contiguous to the :F
present city limits, said unincorporated area of land being described in :section 2 below; and
WHEREAS, by Ordinance No. 12615 duly adopted by the City Council on June 2,
1997, and approved by the Mayor, the Council authorized annexation of the unincorporated
area which was the subject of that hearing; and
k � WHEREAS, the City of Jefferson, Missouri, did cause to be filed on June 2a, 199%, in
the 19' Circuit Court of Cole County, Missouri, in Case No. CV197-0846CC, a suit for a
declaratory judgment authorizing the City to annex the area of land described above; and
WHEREAS, the 19'h Judicial Circuit Court on September 11, 1998, rendered a
` judgment in favor of the City of Jefferson, Missouri, in a cause of action entitled "City of
sr Jefferson, Missouri v. Douglas W. Beul, et al.", CV197-0846CC finding the annexation of the
unincorporated area to be reasonable and necessary to the pauper development of the City
of Jefferson, Missouri; and
WHEREAS, the Mayor and City Council of the City of Jefferson, Missouri, believe
elections should be held in the City to determine if a majority of the qualified voters vriting j
'- thereat are in favor of extending he limits of the City to include the unincorporated areas of

land hereinbefore.described.
'Y NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
ft MISSOURI, AS FOLLOWS:
{, Section 1. A proposition to extend the City Limits of the City of Jefferson, Missouri '
so as to embrace and include all that territory located in the County of Cole,Missouri, and as
described in Section 2 below,shall be submitted to the voters of the City of Jefferson, Missouri

and the voters of the unincorporated territory subject to the annexation proceedings, and an
election shall be held and conducted for these two areas on Tuesday, the 2"d day of February, ; :+

Cole - Callaway County Line, said point being the intersection of

held and conducted for these two areas to resubmit the proposition as described in Se ction

necessary, shall be as follows:

The corporate limits of the City of Jefferson, Missouri, shall be extended to include the following
described unincorporated area of land contiguous to the present,city'corporate limits:
BEGINNING at a point in the center of the Missouri River on the Cove- Callaway
County Line, said point being the intersection of tl:e northerly extension of the
westerly line of Private Survey No. 2680 and said Cole - Callaway County Line;
