The proposal from CME Associates for engineering services related to the Shop -Rite Shopping Center Drainage Improvements at a cost not to exceed $7,500.00 is hereby approved. 2. This action is approved as an award of a professional services contract pursuant to N.J.S.A 40A:11- 5(1)(a) in accordance with the Borough's Fair and Open Process as authorized by law. 3. A copy of this Resolution be forwarded to the Borough's Purchasing Department, the Borough Director of Engineering and CME Associates. It is our understanding that the Borough and the owner of the Shoprite Plaza are working to address an existing drainage issue on the southwest portion of the property. Our office has met with your office, the owner, and the owner's contractor to review the issue in the field. Initial observations indicate that runoff from the intersection of Byron Street and Lexington Avenue is directed down a steep driveway on the southwest corner of the property and results in flooding along the rear of the businesses in spaces #764 — #773. Accordingly, our office proposes the following scope of services to advance the project: Preparation of a Topographic Survev Our office will prepare a topographic survey of the area in question in accordance with the State Board of Professional Engineers and Land Surveyors Administrative Rules and Regulations 13:40 -5.1 "Preparation of Land Surveys ". This survey will supplement the existing conditions plan previously prepared for the adjacent shared office space. The services will include the survey of the portion of Block 2903, Lot 1 in the vicinity of the - driveway fro _Byron Street and Lexington Avenue and the existing stormwater system collecting runoff from this area. Concept Plan Preparation Based on the results of the survey phase, our office will prepare a conceptual stormwater plan to address the drainage complaints, including a hydraulic and hydrologic capacity analysis of the existing system and its operation under current conditions. Work in this phase will also include the development of a conceptual stormwater improvement plan to address the flooding and a cost estimate for same. Said fees will be based on the hourly rate or a fixed fee mutually agreed upon in writing. • The above - quoted fees will be in effect for a period of twelve (12) months from the date of this proposal; however, the fees on the hourly rate schedule are subject to change by January 1 of each year.
