j AN, ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND
DISCONTINUING A PORTION OF THE RIGHT-OF-WAY OF CITY VIEW DRIVE LYING
ADJACENT TO AND EAST OF THE CAST LINE OF LOT NO. 6 OF RE-LOCK ESTATES.
WHEREAS, it has been shown to the Council of the City of Jefferson, Missouri, that J
I the owners of land adjacent to and abutting upon the right-of.--way of City View Drive lying
,.; adjacent to and east of the east line of lot no. 6 of Re-Lock estates in the City, have
petitioned the City Council to vacate right-of-way; and
WHEREAS, it has further been shown that it would not inconvenience the public or
4 the citizens of the City to discontinue a portion of the right-of-way for public use as
described in Section 1 of this Ordinance; and
WHEREAS, it has further been shown that it would not inconvenience the public or
the citizens of the City to discontinue a portion of the right-of-way for public use as
subject described in Section 1 of this Ordinance, ect to a reservation f
j rvation,n the City of an easement

in that portion vacated for the maintenance, repair, location and relocation of all sanitary
,h sewer, surface water sewer or public utility facilities now' existing or hereafter to be
constructed within said right-of-way.
NOW, ,THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF f
JEFFEkSON, MISSOURI, AS FOLLOWS:
Section 1. The Council of the City of Jefferson, Missouri, hereby declares it r
necessary, reasonable and proper to discontinue as a right-of-way and forever vacate the
following described right-of-way in said City:
Part of the right-of-way of City View Drive as situate in part of the Northwest
Quarter of the Southeast Quarter of Section 22, Township 44 North, Range
11 West, in the City of Jefferson, County of Cole, Missouri; being more
particularly described as follows:
From the southeast corner of Lot No. 6 of Re-Lock Estates, as per plat of
record in Plat Book 11, Page 874, of the Cole,County Recorder's.Office;
thence N20 01749"E along the easterly line of said lint No. 6, said easterly
} line also being the westerly line'of said City Vier Drive, 201.74-feet to.the '
I POINT OF BEGINNING for this description; thence continuing along said

easterly line the following courses: N20"17'49"E, 67.25 feet to a point 110
feet left of centerline Station 4+50 of said City View Drive; N33'1 1'06"E,
206.16 feet to a point 60 feet left of centerline Station 6+50 of said City View
Drive; N19 008'56"E, 73.51 feet to the northeast corner of said Lot No. 6;
' thence leaving said easterly line on a bearing of S10"29'14"W, 85.08 feet,to
a point fifteen (15) feet east of the easterly line' of said Lot No. 6, as
measured perpendicular thereto, between Stations 6+50 left and 4+50 left of
said City View Drive; thence S33011'06"111 , being parallel to and 15 feet east
of said easterly line, 264.54 feet to the POINT OF BEGINNING.
Section 2. All of that portion of the above vacated property is hereby retained as a
1 perpetual easement or right-of-way for the construction, maintenance, repair, relocation
:¢ and operation of sanitary sewers,surface water drainage, and all public utility facilities, and
no permanent buildings or structures shall be located within or upon said easement without
i the prior written consent of the City.

Section 3. The statutory right of reversion in the owners of the abutting propers`ti is
hereby confirmed, as is provided by the laws of the State of Missouri, and the Mayor and
the Clerk of the City are hereby authorized to execute all necessary instruments required
to confirm the reversionary rights of the owners of property abutting on the area vacated,
as described in Section 1 of this ordinance, in the rightMof way vacated, subject to the
easement retained in Section 2.
Section 4. This Ordinance shall take effect and be in full force from and after its
passage.
