AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING TIME MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH COLE COUNTY, MISSOURI FOR PROVISION OF COMMUNICATIONS SERVICES. '?( BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS, ` SS i Section 11. The Mayor and City Clerk are hereby authorized and directed to execute an agreement with Cole County, Missouri for provision of cornmunications services. f ` t Section 2. The agreement shall be substantially the same in form and content as that agreement attached hereto as Exhibit A. -,` Section 3. This agreement is entered into with the approval of the Commission of the County, and the City Council of the City. The services included shall be twenty-four (24) hour per day dispatch for the Sheriffs department and fire departments and districts which are members of the County which are listed in Exhibit A i including the answering of calls, radio and tone dispatching, emergency contact information, data processing associated.with Computer Aided Dispatching(CAD), and associated communications services. s 2. Hof lE'ers4nne1 for Services. The County and City mutually agree to the following regarding personnel: A. The City will provide to the County information concerning the names, salaries, and benefits of all employees in the Communications Division upon request. r B. The City will station at least two(2)employees at the Communications Console at all times,who will give priority to communications functions while on duty. All decisions concerning individuals employed in the Communications Division shall be the sole responsibility of the City. YE 3. it�a f The City shall be responsible for training all employees referenced above. The Joint Communications Operations Committee scat forth in paragraph 10 may recommend contents for inclusion in employee training programs. All costs of the training program shall be paid by the City. 4- Y All services provided by the City under this agreement shall be delivered at 401 Monroe,Jefferson City,Missouri by the Jefferson City Police Department. Training may be provided off-site as deemed necessary by the City. fi.. Pro-viding t 401 Monroe,, { The City agrees to provide space at 401 Monroe,Jefferson City, Missouri, for all radio, telephone,and any other ' electronic hardware and equipment necessary for the base communications between the center and the County members. City may provide space at other City-owned locations for communication equipment. f' FN=bM gment, ''A. The City through its Purchasing Agent shall facilitate the purchasing, storing, and distribution of all supplies and materials under the provisions of this agreement. B. The County shall provide radio equipment within the county outside the city limits at its sole coat and =jr.4 expense, ]yj ntenance a Lquigment. f Maintenance of equipment shall be the responsibility of the title holder except that all items of equipment ?, ( physically located at 401 Monroe Street shall be maintained by the City with the costs shared according to the formula set out in paragraph 14. `ervices. { i Basic communications services to be provided under this agreement by employees referenced in paragraph 2A l above, shall commence or continue on a county-wide basis as of the date of this agreement. { ' i ; . 9. data�►YYn.�s3 All data entered into the City's Computer Aided Dispatch(CAD)system for all County member departments will i remain the property of the County. The County agrees to pay the City all reasonable costa for the data entries. Upon termination of this agreement,or any extension of this agreement,City agrees to provide file tapes to County at County's cost. City shall have the right to maintain and keep duplicate copies of all data. 10. sT. ft Vii? prnunications Operations CQ mmnittee. A. P ass. A Joint Communications Operations Committee will be formed from representatives of the several County members,including the City of Jefferson. The Joint Communications Operations Committee will advise the Jefferson City Police Department on call answering and communications procedures for law enforcement and fire communications throughout Cole County,including response to mutual aid calls into other counties. B. The Joint Communications Operations Committee shall consist of a member from the Jefferson City Fire Department, a member of the Jefferson City Police Department, a representative of the Cole County e Sherifrs Department, two (2) representatives of other agencies who agree to terms of the Joint Communications Agreement,one(1)member of the legislative body of the City,and one(1)member of the legislative body of the County. i 4 , C. �errass anal Meegf(gL r: # . : The Joint Communications Operations Committee shall meet at least quarterly and its members shall > have two(2)year terms which may be renewed by the appointing authority. D. Attenslauce at Meetings Required. All persons appointed to the Joint Communications Committee shall attend at least two-thirds(=)'of the f regularly scheduled meetings of the Joint Communications Committee. Should any member of the Joint Communications Commission fail to attend two-thirds 2/3 of the meetings occurrin ( ) g gin any one(1)year measured from the time of their appointment, their position on the Joint Communications Comm' aeion shall be deemed vacant and a replacement shall be named as provided. The City agrees to make reasonable efforts to follow the Joint Communications Operations Committee recommendations. A. This agreement shall begin on the 1st day of Janus 1998 and terminate ' r3'� sixty(60)months thereafter, on December 31, 2002, The amount to be paid shall be calculated on an annual basis after the initial twelve(12)months of the terns, on a twelve(12)month basis as set out herein. The twelve (12)months basis shall be a January 1 through December 31 period. The County shall,six(6)months prior to the date of termination of this agreement, notify the City,in writing,of its desire to continue joint communications ! with the City. Should the County holdover beyond the termination date, this agreement shall continue on a month-to-month basis,at a reasonable consideration as determined by the City. During the holdover period, all the terms of the agreement, except the amount of consideration, shall remain in full force and effect. In no event shall the holdover period extend beyond twelve(12)months. t B. This agreement shall be contingent upon receipt of sufficient tax revenues and appropriations by both the City and the County to cover all the expenses and payments referenced in this agreement. C. Should any amounts due the City for compensation from the County under this agreement remain unpaid for more than sixty(60)days after receipt by the County of appropriate documentation from the City,the City may terminate this contract by giving the County thirty(30)days notice of its intent to terminate. Changes in consideration shall be mutually agreed upon by the County and City,at such time as additional communications services are requested. Prior to commencement !! of any communications services,all necessary information concerning boundaries,covered units,covered incidents, i protocols and other items needed for operations must be provided the City. t 14. Up Wgratiam rand Payment Schedule,E ' f A. In consideration for providing the services enumerated in this agreement, the County shall pay the City its share of the fixed and variable costs as determined by the application of the formula established herein to the budget for the City's fiscal year. That sham for January 1, 1998 through December 31, 1998,shall be One Hundred Seventy-Four Thousand One hundred Twenty-Seven Dollars 174 12 ' Y ($ 7)payable in equal monthly iastallments. To determine the County's share of fixed costs, the County shall pay the percent of fixed costs represented by its population outside the City compared to the total population of the County. Variable costs shall be paid on the basis of the percentage of calls attributable to County residents who are not within the City. I B. Fixed costs and variable costs shall be calculated based on the attached Exhibit B,which includes specific numbers for total costs, which will vary from year to year, but the percentage assigned to fixed and ',. variable shall be as set out on the attached Exhibit B. C. The County shall pay the City upon presentation of appropriate documentation and statements by the , City. ;t D. Current function at the courthouse will be retained as a backup by installation of relay module in the dispatch consoles. j 1t. City agreos to make changes in the functions of Channels 1 and 3. C. County has acquired a 12 signal voting receiver comparator which the County agrees to swap in return for the City's 4 signal voting receiver comparator. 'tt 16. g i. All notices required or permitted,hereunder and required to be in writing may be given by first class mail. If to 4 ,. City, notice shall be sent to the Police Chief at 401 Monroe, Jefferson City, Missouri 65101 and to the City Counselor at 320 East McCarty,Jefferson City,Missouri 65101. If to the County, notice shall be sent to the Cole County Commission at the Cole County Courthouse, Jefferson City, Missouri 65101, and to the Cole County Prosecutor at the Cole County Courthouse,Jefferson City,Missouri 65101. The date of delivery of any notice shall by the date falling on the serond frill day after the day of its mailing. 1?.
