AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ESTABLISHING A
' CONVENTION AND SPORTS COMPLEX FUND FOR THE PURPOSE OF DEVELOPING,
y ,,+ MAINTAINING OR OPERATING SPORTS, CONVENTION, EXHIBITION OR TRADE
I FACILITIES WITHIN THE CITY.
WHEREAS, the Council of the City of Jefferson hereby finds and determines it is necessary,
desirable and in the best interest of the City to create a new fund within the
Complex and Sports Complex Fund"
rF City's.hart of Accounts to be entitled,
for the purpose of developing, maintaining or operating sports, convention,
exhibition or trade facilities within the City; and
r WHEREAS, the,State of Missouri has authorized up to $100,000 in planning funds provided
certain requirements are met; and
s ; WHEREAS, the City Council has determined that it should move forward to comply with the �
f state requirements in order to receive the funding. `
BE .IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,'AS 1'
L FOLLOWS:
rtion 1. There is hereby established within the City's Chart of Accounts a special i is
} fund to be designated the"Convention and Sports Complex Fund." The funds shall be for the
sole purpose of developing, maintaining or operating sports, convention, exhibition or trade
facilities within the City.
Section 2. All expenditures of monies from the Convention and Sports Complex f=und
shall be made in compliance with Section 70.859, RSMo (see attached), which,.requires a t
percentage of contracts; constructions and concessions to be awarded to socially and

economically disadvantaged small business concerns and grants preference to Missouri,

' Section 70.859, RSMo.
Section 70.859. Definitions - percentage of contracts, construction and concessions to be
' awarded to socially and economically disadvantaged small business concerns - Missouri products
to be given preference-out-of-state contractors, bidding requirement. -
1. As used in this section, the following words and phrases shall mean:
(1) "Concessions", all goods and services incidental to the operation of a
'! qualifying project including, but not limited to, parking, food, beverage, liquor,
souvenirs, ticket sales, sales of programs, advertising, printing of promotions and
} security,provided to the operator or lessee of the qualifying project pursuant to any
contract or subcontract;
(2) "Economically disadvantaged individuals", socially disadvantaged
residents of this state whose ability to compete in the free enterprise system has been
impaired due to diminished capital and credit opportunities as compared to others in
the same business area who are not socially disadvantaged. In determining the
degree of diminished credit and capital opportunities consideration shall include,but
not be limited to, the assets and net worth of such economically disadvantaged
individuals;
(3) Participating counties and cities",as defined by section 70.843,provided f
such counties are first class charter counties and such cities are cities not within a
county;
(4) "Qualifying project", as defined by section 70.846;
(5) "Socially and economically disadvantaged small business concern", any

(a) Which is at least fifty-one percent owned by one or more socially
and economically disadvantaged individuals; or, in the case of any j
corporation, at least fifty-one percent of the stock of which is owned by one
or more socially and economically disadvantaged individuals; and
i (b) Whose management and daily business operations are ;
predominantly controlled by one or more of such individuals; ;,
(6) "Socially disadvantaged individuals", residents of this state who have

been subjected to racial or ethnic prejudice or cultural bias because of their identity .
as.a member of a group without regard to their individual qualities.

2. The state and any participating counties and cities shall provide with respect to each

qualifying project: <:!i
(1) That at least ten percent of the total dollar value of the contract or
contracts for construction of the qualifying project,and structures and improvements
associated with operation of the qualifying project, or rehabilitation or remodeling }

of any structures for use as or associated with the use of the qualifying project, shall
be set aside,awarded to and procured from socially and economically disadvantaged ;

3. The authority and any city, county, other political subdivision or public agency

provisions of sections 34.073 and 34.076,RSMo. .
