Minutes of Public Hearinq
Monday, April 3'a, 2023 -
The Brewster Old King's Highway Regional Historic District Committee, acting under the
Massachusetts General Laws, Chapter 470, Acts of 1973 as amended, came to order at 7:00 pm
in person and being recorded at the Brewster Town Hall. Committee members present were Jim
Trabulsie (Chairperson), Steven Bergquist, Pat Busch and Tom Turcketta. The Chairman, Jim
Trabulsie determined a quorum.
SCHEDULED APPLICATIONS
H-23-9
Janice Jones, 55 The Tides Court, Map 58 Lot 40
Solar Panels
• Members present and voting: Jim Trabulsie, Tom Turcketta, Steven Bergquist and Patricia
Bausch.
• Trinity Solar was there to represent the applicant but couldn't be heard due to technical
difficulties. It was decided to table the discussion and revisit after the other applicants.
• After discussing other applications, the Committee was informed that Brandon with
Trinity Solar was online to represent the applicant.
• Brandon described the 18 solar panels project across two of the south facing roof plains.
One of the sides; the low pitch one which wouldn't be visible from the road, but the
other two panels that would be more visible.
• Jim asked if there were any abutters and there were none.
• Tom Turcketta made a motion to approve as presented. Pat seconded. A vote was taken,
and the application was approved unanimously as presented.

Solar Panels
• Despite E2Solar submitting an application, the address above was not in the Historic
District so the committee had no jurisdiction on the project.

Inground Swimming Pool
• This committee has no jurisdiction on pools only on some fences. Even though pictures
of a fence were attached to the application, there was no description or fence details and
the committee was not able to review it.

Solar Panels
• Steve Kelly with Sunrun represented the applicant. Steve described the project as 20 flat
black solar panels on the roof of the property with no battery.
• Steven and Jim commented on how the evergreens in front provided a great barrier from
Main Street.
• Jim asked for a memo to be added to the permit stating that the trees had to stay and if
they were to die, they would need to be replaced.
• Tom said he was ok with the project as long as the memo was included.
• Jim asked if there were any abutters on the line, there being none, Steven made a
motion to approve with the inclusion of the memo. Pat seconded the motion. A vote
was taken and the project was unanimously approved.

Vernon Smith, 2208 Main Street, Map 68 Lot 125 Ext 1792
Sign Replacement
• The applicant was not present at the meeting so the committee decided to table the
discussion and revisit at the end of the meeting.
• After hearing the rest of the applicants, the committee checked and there was no
representation for the sign on 2208 Main Street.
• Tom pointed out that the proposed sign was the exact same size and look so he
suggested they hear the application anyway.
• The committee discussed the proposed sign and decided that the only difference they
saw was the background color of the sign from white to gray.
• Jim asked if there were any abutters, but there were none.
• Steven made a motion to approve as presented.
• Tom seconded the motion and all four members voted to approve the application.

John Fishman, 888 Long Pond Rd, Map 86 Lot 12
Solar Panels
Ed Boyle with My Generation represented the applicant. Ed explained that the project
consisted of 19 flat black roof mounted solar panels about 120 feet away from the road.
He also said that there was good tree coverage and a house to the south of the property
helped with it as well.
Jim had some questions on the exact location of the solar panels because of the
incorrect arrows on the drawings submitted.
Steven asked if the south facing house was a historical building and if there were plans
to demolish it. The homeowner said they had looked into it in the past, but they were
not going to move forward with it.

• Jim read the abutter letter from Gayle Hanson (see attached) where she stated that she
had no issues with the proposed solar panels.
• Jim said that in his opinion, this project met the minimum visual impact criteria.
• Pat stated that she had not driven by the property for a site review and that she was
abstaining herself from voting on it.
• Ed Boyle also brought up the fact that most people wouldn't see the panels due to the
speed of vehicles on that road.
• Tom made a motion to approve as presented. Steven seconded. A vote was taken and
Tom, Jim and Steven voted to approve application H-23-44.

Ocean Edge, 2907 Main Street, Map 90 Lot 160
Shade Sails
• Tom Devine was there representing Ocean Edge.
• Tom Devine started by saying that they were applying for the shade sails for their second
year in a row due to the extension of the outdoor dining legislations.
• Tom Devine showed an additional plan, which was last year's, to show the exact locations
of the proposed shade sails. He then asked to be approved for 17 shade sails rather than
the 10 they applied for.
• Jim asked the applicant to apply for an amendment and to include a plan showing
exactly where all sails were proposed.
• Tom Devine mentioned they had added an additional awning requested by the Health
Department. The awning would cover the space between the pizza oven and the kitchen
shed. This awning would be made of clear plastic open on all sides and that it would be
removed at the end of the season.
• Tom Turcketta made a motion to approve as presented. Steven seconded and the
application was unanimously approved.
INFORMAL DISCUSSION
Minutes
December 19th, 2022
o Tom made a motion to approve the December 19th meeting minutes as
presented. Steven seconded the motion; a vote was taken, and the December 19th
meeting minutes were approved unanimously.
February 6th, 2023
o Tom made a motion to approve February 8th meeting minutes as presented.
Steven seconded the motion. A vote was taken, and February's minutes were
approved.

o Tom and Pat were not present at that meeting so they abstained themselves from
voting. Steven made a motion to approve the minutes as presented. Jim
seconded and the March 7th meeting minutes were approved.

Committee voted unanimously to adjourn.
