ATING AND
ITY OF JEFFERSON LEONARD DRIVE FROM LOLA
'i DISCONTINUING A PORTION OF A RIGHT-OF-WAY O
DRIVE TO SOUTHERN AIR DRIVE.
WHEREAS, it has been shown to the Council of the City of Jefferson,
Missouri, that
`j the owners of land adjacent to and abutting upon a right-of-way in the City, have petitioned
the City Council to vacate right-of-way; and

4 WHEREAS, it has further been shown that it would not inconvenience the public or
the citizens of the City to discontinue a portion of right-of-way for public use as described :a•
in Section 1 of this Ordinance; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Council of the City of Jefferson,
Missouri, hereby declares it
y necessary, reasonable and proper to discontinue as aright-of-way and forever vacate the i
following described right-of-way in said City:

All that part of the sixty(60)foot wide Leonard Drive right-of way frorrr the northerly
line of Lola Drive to the southerly line of Southern Air Drive as per the plat of record
F of Herman John Subdivision, Section Three, as filed in Plat Book 8, Page 117, of the
Cole County Recorder's Office; said right-of way being more particularly described .
as follows:
BEGINNING at the southeast comer of Lot No. 51 of said Herman John Subdivision,

x and the westerly line of said Leonard Drive; thence S71°20'E along the easterly
extension of the northerly line of said Lola Drive, 60.56 feet to the easterly line of

radius of 235.00 feet, an arc distance of 57.16 feet(the chord being S18 054'55"W,
57.02 feet) to the POINT OF BEGINNING. ; e
T Section 2. All of that portion of the above vacated property is hereby retained as a
perpetual easement or right-of-way for the construction, maintenance, repair, relocation
and operation of sanitary sewers, surface water drainage, and all public utility facilities. In
addition, the easterly twenty (20) feet of the above described property is hereby retained
as a perpetual easement or right-of-way for the construction, maintenance, repair,
relocation and operation of a pedestrian and bicycle path. No permanent buildings or
structures shall be located within or upon said easements without the prior written consent
of the City.
Section 3. The statutory right of reversion in the owners of the abutting property is
hereby confirmed, as is provided by the laws of the State of Missouri, and the Mayor and
the Clerk of the City are hereby authorized to execute all necessary instruments required
to confirm the reversionary rights of the owners of property abutting on the area vacated, ;U
as described in Section 1 of this ordinance, in the right-of-way vacated, subject to the '.
easement retained in Section 2.
Section 4. This Ordinance shall take effect and be in full force from and after its
passage.
