AN ORDINANCE OF THE CITY OF JEFFERSON,MISSOURI, ESTABLISHING MINIMUM 1 ; ; REGULATIONS GOVERNING THE DESIGN, CONSTRUCTION, ALTERATION, ENLARGEMENT,REPAIR, DEMOLITION, REMOVAL,MAINTENANCE AND USE OF ALL BUILDINGS AND STRUCTURES; PROVIDING FOR THE ISSUANCE OF PERMITS, COLLECTION OF FEES AND CONTRACTOR LICENSES, MAKING OF INSPECTIONS; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; TO BE KNOWN AS THE BUILDING CODE; REPEALING ORDINANCE 11578; REPEALING SECTION 8-18, OF f THE CODE OF THE CITY OF JEFFERSON, MISSOURI AND ENACTING 7 SECTIONS IN LIEU THEREOF. BE,IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI AS 'i FOLLOWS: l Section 1. Adoption of Buildin Code y That a certain document, three (3) copies of which are on file in the office of City =' Clerk, of the City of Jefferson, being marked and designated as "The BOCA National Building Code, Thirteenth Edition, 1996" as published by the Building Officials and Code Administrators International, Inc., be hereby adopted as the Building Code of the City of Jefferson in the State of Missouri, for the control of buildings and structures as herein provided. Each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Building Code, are hereby referred to, adopted and made a part thereof as if fully set out in this ordinance, with the additions, insertions, deletions and {` changes, if any, prescribed in Section 3 of this Ordinance. Section 2. Inconsistent Ordinance Repealed t Ordinance number 11578, of the City of Jefferson, Missouri, entitled "The Building Code of the City of Jefferson", is hereby repealed. 1 , Section 3:_ 'A►c ditions.• Insertions and Changes The following additions; insertions, deletions and changes are made to the BOCA ; f National Building Code, Thirteenth Edition, 1996 otherwise referred to herein :as the ; sr "13 u'rldirvg Code of the City of Jefferson; _ Bill 98-13 . Page 1 ,r Ott 2 Fi° + lr • r7 s x' a P t4' r { + ray t a,etii 7 31 y L t �t4 3 a ��t 1 } f .!> ,A Section 101;1: insert the words "City of Jefferson" as FJ name of jurisdiction. �, ton. r �r� l �2) Section 104.0 Delete Sections 104.1-104.5 and insert the following in its place: Section 104.1 BUILDING OFFICIAL The department of building inspection known as the Department of Planning and Code Enforcement is hereby continued and the executive official in charge thereof shall be known as the Director of Planning and Code Enforcement. ` Wherever the words building official appear in this code, it shall be held to mean the director of Planning and Code Enforcement or his designee. Section 104.2 APPOINTMENT ` The director of Planning and Code Enforcement shall be r r.' appointed and removed as provided by ordinance. section 104.3 ORGANIZATION 44 The Director of Planning and Code Enforcement shall ' recommend to the City Administrator the employment of building inspectors in sufficient numbers to assure enforcement ' of the building code. Section 104.4 DEPUTY The director of Planning and Code Enforcement may designate the division director of building regulations as deputy,who shall exercise all the powers of the director during the temporary absence or disability of the building official. Section 104.5 (QUALIFICATIONS AND DUTIES OF EMPLOYEES ii f rt The qualifications and duties of the employees of the department of Planning and Code Enforcement shall be in k ` accordance with the Personnel Rules and Regulations for the z r ({ Municipal Service of Jefferson City, Missouri. , t (3) Section 112.6 „ Insert the following: Bill 98-13 Page 2 f t ` T�Y h it y 4 r zs t z } FEE FOR PENALTY FOR FAILURE TO OBTAIN A BUILDING F PERMIT: ' Where work for which a permit is required by this Code is started prior to ' obtaining said permit, the fees specified in Section 8-20 of the Code of the City of Jefferson shall be doubled. Should any person, firm or corporation f commit a second offense by starting work without permit after so doing on a previous occasion, he shall pay three times the customary fee in order to obtain the necessary permit. Any offense shall subject the offender to I ' prosecution under section 116.4. In the event any person firm or corporation fails to obtain the necessary permit(s) within 5 days after being notified in writing to do so by the Code official, he shall pay in addition to the usual fee or increased penalty as provided above the sum of $5.00 for each day in F. excess of the aforesaid 5 days that transpire prior to his obtaining the necessary permit. The payment of any or several of the above stated penalty i fees shall not relieve any person,firm or corporation from fully complying with the requirements of this code in the execution of the work nor from any other penalties prescribed herein. f (4) Section 116.4 Delete this section and insert in lieu thereof the following: VIOL,MON PENALTIES: Any person who shall violate a provision of this Code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan or directive of the building official, or of a permit or certificate issued under the provisions of this code, shall be punished by a fine of not more than $500. or by imprisonment not exceeding 180 days, or both such fine and imprisonment. Each day that a violation continues shall be deemed a separate offense. (5) Section 117.2 Delete this section and insert in lieu thereof the following: EE UNLAWFUL CONTINUANCE: I < � l,f Any person who shall continue any work in or about the structure after having ' been served with a stop work order, except such work as that person is 1 directed to perform to remove a violation or unsafe conditions, shall be liable to a fine of not less than $25.00 or more than $500. Y Section 121.0: ME&N S OF APPEAL• VA r l Any awner, agent or other person shall have the right to appeal a decision x ,the code official refusing to grant a modification to the provisions of this code covering the manner of construction or materials to be used in the erection, alteration or repair of a building or structure. An application for appeal shall be based on a claim that the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted, the provisions of this I code do not full apply,y pp y, o r an equivalent form of construction can be used. The appeal shall be to the circuit court of Cole County as established in Article 536 of the Revised Statutes of Missouri. t (J) Section 1610.1, insert the following exception, 5. Validit.�,► The City Council hereby declares that should any section, paragraph, sentence or word of this ordinance or of the code hereby adopted be declared for any reason to be invalid, it is the intent of the City council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion ?: as may be declared.invalid. Section 6. Cate of Effect. This ordinance shall take effect and be in force from and after its passage and approval.
