AN ORDINANCE OF THE CITY OF JEFFERSON,MISSOURI,AMENDING CHAPTER 8 OF THE t CODE OF THE CITY OF JEFFERSON BY REPEALING THE PRESENT SECTIONS 8-49 AND 8-50 AND ENACTING IN LIEU THEREOF A NEW SECTION 8-49, ENTITLED "ADOPTION OF THE BOCA NATIONAL PROPERTY MAINTENANCE CODE,FIFTH EDITION, 1996;AND A NEW SECTION 8-50 ENTITLED "AMENDMENTS, INSERTIONS AND DELETIONS TO THE BOCA NATIONAL PROPERTY MAINTENANCE CODE, FIFTH EDITION, 1996". NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, ' MISSOURI, AS FOLLOWS: Section 1. Chapter 8 of the Code of the City of Jefferson, Missouri, is hereby amended by repealing the present Section 8-49, entitled "Adoption of the BOCA National Existing Structures Code, second edition, 1987," and enacting the following new Section 8-49, entitled "Adoption of ; the BOCA National Property Maintenance Code, Fifth edition, 1996": Section 8-49. Adoption of the BOCA National Property Maintenance Code, Fifth Edition, 1996. The BOCA National Property Maintenance Code, Fifth edition, 1996, as published by the Building Officials and Code Administrators International, Inc. is hereby adopted and incorporated herein by reference as the Property Maintenance Code of the City of Jefferson,with the additions, insertions, deletions and changes contained herein. Section 2. Chapter 8 of the Code of the City of Jefferson, Missouri, is hereby further amended by repealing the present Section 8-50, entitled "Amendments, insertions and deletions ;<< to the Existing Structures Code," and enacting the following new Section 8-50, entitled "Amendments, insertions and deletions to the BOCA National Property Maintenance Code, Fifth Edition, 1996.” Section' 8-50. Amendments, insertions and deletions to the Property Maintenance Code. The following additions, insertions, deletions and changes in the BOCA National Property Maintenance Code, Fifth edition, 1996 and contained in Ordinance No. 12758, shall be asset out � below: x A. Definitions: 1: :t r 1. Whiereuer,the word"municipality"is used in the Property Maintenance Code, it shall beheld to mean the City of Jefferson, Missouri. Where tha,job title"code official" is used in the Properly Maintenance Code r ' it shall be.held to mean the Director of Planning and Code Enforcement. Wherever the term"department"is used in the Property Maintenance Code it shall be held to mean the Department of Planning and Code Enforcement. 4. Wherever the term "legal representative" is used in the Property j Maintenance Code, it shall be held to mean City Counselor for the City of Jefferson, Missouri. B. Duties of the code official and his designated Housing Inspector(s). 1. The Property Maintenance Code shall be enforced by the code official or his designee. 2. The code official shall maintain or cause to be maintain a written record of `. all inspections, violations and the disposition thereof and to prepare . therefrom an annual report containing all proceedings under this code to be transmitted to the City Administrator of the City of Jefferson, Missouri. C. Delete Sections PM-105.6 through PM-105.9 and PM-109.6,PM-110.0 through PM- 110.4, PM-111.1 through 111.6. ' Delete Section PM-106.2 and replace with the following: � t Penalties: z, 1. Any person who shall violate any of the provisions of the code hereby adopted or fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement or specifications or plans submitted and approved thereunder, or - any certificate or permit issued thereunder, and from which no a :t PP eal has been taken or who shall fail to comply with such an order as affirmed or ' modified by the City Councilor by a court of competent jurisdiction,within the time fixed herein, shall severally for each and every such violation and noncompliance respectively, be guilty of a misdemeanor, punishable by a fine of not less than $25.00 nor more than $500.00 or by imprisonment for no more than 180 days or by both such fine and imprisonment.
