AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI,AMENDING CHAPTER 8 OF THE CODE OF THE CITY OFJEFFERSON, MISSOURI, BY ENACTING A NEW ARTICLE RESERVATION AND IV PERTAINING TO BUILDING AND NEIGHBORHOOD P CONSERVATION AND FURTHER REGULATING THE DEMOLITION OF BUILDINGS ,ro *URRENT PROVIDE AN OPPORTUNITY FOR PRESERVATION AND RENUMBERING THE C ARTICLES OF CHAPTER 8 OF THE CODE. BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OirJEFFERSON, MISSOURI, AS FOLLOWS: ldincLs Section 1. A new Article IV (Preservation and Conservation) of Chapter 8 and Building Regulations) of the Code of the City of Jefferson, Missouri, is hereby inserted and enacted to read as follows: !ON. ARTICLE IV. PRESERVATION AND CONSERVAT See.&39. Statement of Purpose. A. The purposes of this article are to promote the education cultural,economic, and general welfare of the community by: n Providing a mechanism to Ide tify and preserve the di3tinctive.historie, archaeological and architectural characteristics of the Caty or jefferson which represena elemer.13 of the city's cultural,social,economic,polifical and architectural history; 2. Promoting the identificatioaa,evaluation,protection and interpiretation of the prehistoric and historic archaeological resources within the corporate limits of the city. I { Sec.840. Relationship Between Districts. �i A. An application for a designated district shall be evuluate�+ on as sliding scale, depending upon the designation of.the building, structure, site or object in question. The application shall be evaluated on the following criteria: 1. Most careful scrutiny and consideration shall be given to applicatia►ls for designated landmarks and historic districts; 2. Slightly less scruday shall he given to applications for designated � conservation districts; si Hated conservation district shall receive a decreasing 3. Properties deg scale of evaluation upon application; and 4. The least stringent evaluation is applied to the neighborhood s conservation planned district where the design standards are advisory ; in nature. i Sec.841. Definitions. Unless specifically defined,words or terms in.appendix A ofthis article shall be int erpreted °t- so as to give them the same meaning as they have in common usage and so as to give this article its most reasonable application. Sec.842. Surveys and Research. The City of Jefferson 1istoric Preservation Commission((:JHPG),as created by section]- 41 of the city code,shall undertake an ongoing survey also research effort in the City of Jefferson x' to identify. neighborhoods, areas, sites, structures and objects that have historic cultural, archaeological,architectural or aesthetic importance,interest or value As part of the survey, ac►d ; t shall review said evaluate any prior surveys and studies by any aenit of government or.private A+ organization and compile appropriate descr{ptions,facts and photographs. The potential landmarks and historic district exhibit a particular architectural style or school, or are associated wits). a particular architect, engineer, builder, designer or craftsman; D. The potential landmarks and historic districts contain historic,prehistoric and archaeological features, evidence acid/or artifacts which have the potential to contribute to tM�e understanding of historic and prehistoric cultures; or E. Such other criteria as may be adopted by the C-IRPC to assure. the systematic survey and nomination of all potential landmarks and historic distri.ctg within the city. Sec.843. Neighborhood Conservation District Regulations. } A. Intent. The neighborhood conservation district is intended to be applied to areas � 'f of the city in order to conserve areas which retain the character of earlier periods of development, to stabilize and improve property values in such areas, to encourage rehablWa,tion of existing { structures,and to promote new construction that is compatible with the character of the are2. R. Criteria for Naniination. The criteria for nomination shall apply to appliesitions for designation of all neighborhood conservation districts. The department of planning and code r enforcement shall,upon investigation as it deems necessary,make a determination as to whether ' a property,structure,site,area or district meets one(1)or more of the following criteria; Yr . I. The area retains the general character and appearance of its historic period of development; 2. The area demonstrates potential for rehabilkation of existing housing in � the area; 3. The degree to which'the area displays continuity,including bath sides or facing blocks as much as possible; { 4. It is associated with a significant local,state or national historical event; 5. It includes structures associated with lives of people who have.made a significant historical contribution;or G. It contains structures that embody the distinctive characteristics of a type,period,or method of construction,or that represent the work of a i 4 master,or that possess high artistic values,or that represent a significant ` and distiirguisCiuble entity whose components may lack individual distinction. s{ } C. Each neighborhood conservation advisory district must be nominated by a separate application. Before approving,a nomination, the departctrent shall approve a set of neighborhood design guidelines for the district in accordance with this section. Review Process. The following review process shall apply to applications for designation of neighborhood conservation advisor districts. a. The application shall he reviewed by the department to j determine compliance with criteria established in this section. b. A decision to deny an application shall be made in writing and shall state the specific reasons for denial. C. Appeals from the decision of the director of planning wind code :. enforcement shall be made to the planning and zoning commission in accordance with the provisions of Chapter 35 of the Code of Jefferson City. 4. Neighborhood Design Guidelines. a. The department shall assist the neighborhood group in developing written neighborhood design guidelines for submission and approval b. When the department has approved the neighborhood) design r. f: guidelines, each applicant for a building permit within areas designated as a neighborhood conservation advisory district shall be advised of those guidelines. D. Neighborhood Conservation Planned District. The regulations pertaining to this ; J district shall include existing structures,nev;construction,additions,alterations,rehabilitation, ( ,` renovation and remodeling. 1. Aeplication/Noadnation. In considering applications for nonr�natlon of neighborhood conservation planned districts,the department shall be guided by the neighborhood design standards and any specific design guidelines adopted by the CJhPC. a. Applications for nomination of an historic district shall be made to the CJhPC by at least seventy-Fv�e percent(75%)of all owners of record. Forms and criteria for nomination will be available at the office of the department of planning and code enforcement. Applications must be submitted to the department; the department shall forward applications to the CJhPC. Each historic district must be nominated by a separate application. Each historic district must be designated by a separate ordinance. The designation of a historic t t ff district shall in no way alter the uses permitted by the existing zoning district of the property so designated. f B. Notice. Upon receipt of an application for nomination of an historic district,the department shall notify the property owners within the proposed district of lire app!lcatian,. Its Identification as a work of a master builder,deaiigner,architect,or landscape architect whose individual work has influenced th development of the communloy,county,state or nation; 6. Its embodiment of eieanents of design, detailing, rnaterial?, or craftsmanship that render it srchitecturralby significant; 7. Its embodiment of design elements that make It structurally or architecturally Innovative; 8. Its unique location or!singular physical characteristics that make it an € ° k4.f, established or familiar visual feature:;or { i 9. Any site,structure,object,or area that meets one(1)or more of the above criteria,shall also have sufficient integrity of location,design,materials and workmanship to make it worthy of preservation or restoration. y D. ' See.845. Nomination of Landmarks A. AnDlication/Nomination. Applications for nomination of a site, structure or object as a landmark shall be made to the CJP.PC. Forms and criteria for nomination will be a� available at the office of the department of planning and code enforcement. Each landmark must ; F: be nominated by a separate application. Procedure for review following designation of landmark or rhetoric districts. I A. Building Permit Standards. After a tandnialrk or historic distr ict is designated by ordinance each,application for building permit within the area so designated shmil be referred to the CJIIPC for review at a regularly scheduled ClHPC meeting. Applications shell be submitted a minimum of ten (10) days prior to the meeting or the Continission. if the CJ14PC makes no i report within forty-rive(45)days of receipt of the application,it shall be considered to have Made a report approving the application. ' B. Desian Criteria. The CJIIPC shall prepare and adopt specific design criteria as it deems necessary to supplement the provisions of this ordinance.,Within each of the designated categories,the design criteria will be applied more stringently to properties of greater significance ., than those with lesser significance as determined by their respective designation.The CJHPC may from thne to time amend and supplement to the criteria used for review of historic districts rend � }, landmarks.The CJIIPC must first approve additional design criteria not listed in this chapter,and y an changes thereto,before the criteria or changes shall become effective. f r Section 2. Section 8-32 (Permit) of Article Ill (Demolition or Removal of Buildinsas) of i Chapter 8 (Buildings and Building Regul ations)of the Code of the City of Jefferson, Missouri, is hereby repealed and a new Section 8-32 (Permit t+o Demolish) is inserted and enacted to i. read as follows: Sec.8-32. Permit to Demolish. 1 A. Permit Re uired. It shall be unlawful to demolish or remove any building, structure or humanly constructed object anywhere in the City of Jefferson%tiithout first filling an application with the director of planning and code enforcement or his designee in writing and obtaining a demolition permit. Demolition shall be construed to include n.n act or process which destroys,in part or in whole, a structure or which threatens to destroy a structure by failure to maintain it in a condition of good repair and maintenance. A permit to demolish or remove shall not be issued until a release is obtained froaaa the ntili9ies having service connections with the building. The release shall state that service connections and appurtenant equipment, such as meters and regulators, have been removed or sealed and plugged In a safe manner. Any j application for demolition or removal shall be subject to a thirty (30) day review period by the CJIIPC. Any recommendation by the CJHPC shall be advisory only,'Nothing in this section shall be construed so as to prohibit the building commisdoner from acting under any emergency t provisions of Chapter 8 of the Code of ahe City of Jefferson,Missouri. B. Review Process. fj Deraartment.All applications for permission to demolish a building or t structure shall be made to the department of pla lining and code enforcement. After examining on application and finding that it is in proper form,contains alt necessary information,and complies with all I applicable provisions of city ordinances,the department shall forward ,+ a copy of the application to CJIIPC. - 8 - 'f•. The visual and spatial relationship of the building or structure to designated or potential historic landmarks or histoHeal districts; 3. The state of deterioration or disrepair or structural un3oranr3ness of the building or structure, and the practicability of rehabilitation. The CJHPC may request the applicant to submit documentation in a form specified by the CAIPC or other information necessary to determine f; whether the property can be rehabilitated or restored with a reasonable :. economic return to the Owner. D. Approval or Disavoroval. Within five (5) days after either: (I) the CJHPC's determination;or(2)the expiration of the thirty(30)day review period,whichever occurs first,the directorof planning and code enforcement shall approve or not approve the application.A negative recommendation by the CJHPC shall not be grounds for disapproval of the.application. Section 3.Article IV(Property Maintenance Code)of Chapter 8 of the Cade of the City �t of Jefferson, Missouri, is hereby renumbered as Article V (Pror)erty Maintenance Code). Section 4. Article V (Flood Hazard Regulations) of Chapter 8 of the Code of the City of Jefferson, Missouri, is hereby renumbered as Article VI (Flood Hazard Regulations). Section 5. Article VI (Dangerous Building Regulations)of Chapter 8 of the Code of the f r City. of Jefferson, Missouri, is hereby renumbered as Article VII (Dangerous Building Regulations). Sec ion 6. SEVERASILITY. If any section, subsection, subdivision, paragraph, subparagraph, item, sentence, clause, phrase or word of this Ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall riot affect the. remaining portions of this Ordinance which shall remain in full force and effect as if the portion ?` so declared or adjudged invalid or unconstitutional was not originally a part of.this Ordinance. .. Unless specifically defined words or terms in appendix A of this article shall be interpreted so as to give them the same meaning as they have in common usage and so as to give this article its most reasonable application. :hd"tive fuse. Architectural attributes. Those physical features of buildings and straactuees thot are gfneraliy identified . and described as being important products of human thought and action ebaracteristic of a population or i community. Certified local government (CLG) A program of the rational Park Service designed to promote the d; preservation of prehistoric and historic sites,structures,objects,buildings and historic districts by establishing a partnership between the local government,the state historic presentation department and the National Park Service. ,.. A certified local government carries out the purposes of the National Historic Preservation Act,as amended. Each , certified local government is required to maintain a system of ongoing surveys compatible with the Missouri Historic 3 X Preservation Department process. jCJHPC. The City of Jefferson Historic Preservation Commission. Commissioners. Members of the City of Jefferson Historic Preservation Commission. Consent. The vote as cast by owners holding majority interest in a parcel of real estate. For purposes of this article,only one(1)vote per parcel may be cast. Conservation district. Any area designated by the CJHPC in accordance with this section as an area containing any physical features or improvements or both which are of historical,social,cultural,architectural or aesthetic significance to the city and cause such area to constitute a distinctive section of the city. This overlay zone may be used for areas which have distinctive characteristics that mire.'worthy of conservation, but lack sufficient ! j historical,architectural or cultural significance to qualify as historic areas. It was present during the pertinent historic tisne; B. An immediate threat which will result in loss of or collapse of a structure; t B. An immediate threat or destruction by private action;or C. Condemnation for code violations. 1 !. (Sometimes referred to as a "threatened resource"). Exterior architectural appearance. The architectural character and general composition of the exterior of a structure,including but not limited to the kind,color and texture of the building material and the type,design and character of all windows,doors,light textures,signs,and appurtenant elements. Facade. The exterior face of a building which is the architectural front, sometimes distinguished by elaborbtlon or architectural or ornamental details. Historic district.
