AUTHORIZING THE REJECTION OF BIDS AND AUTHORIZING
RE- BIDDING FOR CARTE RE,T WATERFRONT
NORTHERN AND SOUTHERN WALKWAYS PROJECT
WHEREAS, the Borough of Carteret, (the "Borough ") has previously solicited and
received bids for the Carteret Waterfront Northern and Southern Walkways Project (the
"Project ") on September 3, 2020; and
WHEREAS, upon a review of said bid submittals for the Project, the Borough's Law
Director has determined that an award of a contract by the governing body for the desired
and necessary Project work would result in the award of such specified alternative
proposals in the bid specifications as would exceed the base bids received by more than
fifty percent (50 %) in violation of the provisions of the New Jersey Local Public
Contracts Law, specifically N.J.S.A. 40A:11- 23.1(d) ( "LPCL "); and
WHEREAS, based upon the advice of the Law Director, the governing body has
determined that it is in the best interests and service of the Borough and its residents as
intended by LPCL to reject the previous bid submittals and solicit new bid submittals in a
form that would allow for the awarding of a contract for the total necessary and desired
Project work that conforms to the requirements of the LPCL.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey, that all of the bid submittals
received for lire Carteret Waterfront Northern and Southern Walkways Project are hereby
rejected, and the return of all of the bidders' bid bonds is hereby directed, along with a
notification of the rejection of all bids.
BE IT FURTHER RESOLVED that the Borough's Consulting Engineer on the Project,
Najarian Associates, is hereby directed to prepare the necessary and desired bid plans
and specifications as noted and, in conjunction with the Borough's 'Director of
Engineering and Purchasing, Department, is hereby authorized to solicit new bid
submittals for the Project in accordance with the Engineer's modification of the bid
specifications for the same.
BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded to the
Borough's Purchasing Department, Director of Engineering and Najarian Associates.

and certified as a true copy of the
original on October 2, 2020.
