HomeMy Public PortalAboutOrdinance No. 960-03 06-24-2003 .ORDINANCE NO. 960-03 AN ORDINANCE OF THE CITY OF RICHLAND HILLS, TEXAS AMENDING CHAPTER 13 TO REVISE MEMBERSHIP, VOTING, AND QUORUM PROVISIONS FOR THE ECONOMIC DEVELOPMENT ADVISORY BOARD ;PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR PUBLICATION AS REQUIRED BY LAW; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Richland Hills is a home rule city acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, the City Council has previously created the Economic Development Advisory Board by ordinance codified in Chapter 13 of the City Code; and WHEREAS, the City Council has now determined that said Board should be reduced in size from ten regular members to five regular members, and from three business members to two, and to clarify that the business member positions shall be non-voting, and not counted in determining a quorum; • NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: SECTION 1. AMENDMENT OF SECTION 10-91 Section 10-91 of Article III of Chapter 10 of the Richland Hills City Code is hereby amended to provide as follows: Creation; qualifications of members. There is hereby created the Richland Hills Economic Development Advisory Board. Regular members and alternate members of the Economic Development Advisory Board shall be registered voters within the city on the date of their appointment. Non-voting members may be persons not registered to vote within the city, but must own, operate, or be affiliated with or employed by a business interest within the city. Any of such non-voting members having business interests in the city may, by written designation filed with the city manager, appoint a qualified substitute of similar background and experience to attend one or more meetings of the economic development advisory board in the member's place and stead. No member may serve in any capacity on more than one other city standing board, commission and committee, or any special committee exceeding six months' duration; csr serve as city representative to a local, state or national organization. All members shall serve without compensation. • • SECTION 2. AMENDMENT OF SECTION 10-92 Section 10-92 of Article III of Chapter 10 of the Richland Hills City Code is hereby amended to provide as follows: Composition, appointments and terms of members. (a) The economic development advisory board shall be composed of five regular members who shall hold designated places 1, 2, 3, 4, and 5, along with two alternate members and two non-voting business members. All appointments to boards, commissions and committees shall be made by the city council. Each regular member shall be nominated by the councilmember holding the council seat or place corresponding to the numbered place of such regular member. Alternate members and non-voting business members shall be appointed at large and not by council place, and any councilmember may nominate persons for appointment as at-large alternate members and non-voting business members. All nominations shall be deemed approved unless rejected by the affirmative vote of four councilmembers. Regular members shall serve for a term coinciding to the term of the respective councilmember who appointed such regular member, regardless ofthe date of appointment. Alternate members and non-voting business members shall serve two-year terms from the date of their appointment. • (b) The city staff representative to the economic development advisory board shall be the city manager or his designated representative. SECTION 3. AMENDMENT OF SECTION 10-95 Section 10-95 of Article III of Chapter 10 of the Richland Hills City Code is hereby amended to provide as follows: Meetings, rules of procedure and quorum. The economic development advisory board shall hold meetings regularly at least once each month at a time and place designated by majority vote of the members. The economic development advisory board shall, in matters of procedure, be governed by Robert's Rules of Order, Newly Revised, and may adopt such additional rules of procedure as it may deem necessary. A majority of the currently appointed regular members shall constitute a quorum for the transaction of business. In the event of absence of any regular member, an alternate member who is present may serve as a voting member for such meeting, and may be counted for the purpose of determining the presence of a quorum. SECTION 4. AMENDMENT OF SECTION 10-98 Section 10-98 of Article III of Chapter 10 of the Richland Hills City Code is hereby amended to provide as follows: Powers, duties and limitations. The powers and duties of the economic development advisory board shall be as follows: (1) Recommend to the city council policy alternatives which will promote and enhance economic development while ensuring quality of life in the city. (2) Recommend to city council policies which attract new businesses and assist existing businesses. (3) Recommend to city council policies which encourage commercial development and redevelopment. (4) Coordinate, schedule and host meetings of members of the business community in order to facilitate a positive relationship between the city and • the business community. (5) Establish a data base of information relating to market characteristics, labor force, land availability, labor availability and capital availability in the city. Notwithstanding any of the foregoing, no debts of any kind or character shall be made or incurred by the economic development advisory board or by anyone acting in its behalf. SECTION 5. PROVISIONS CUMULATIVE This ordinance shall be cumulative of all provisions of ordinances and of the Code of Ordinances of the City of Richland Hills, Texas, as amended, except where the provisions of this ordinance are indirect conflict with the provisions of such ordinances and such Code, in which event the conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 6. PROVISIONS SEVERABLE It is hereby declared to be the intention of the City Council that the phrases, clauses, • ORDINANCE AMENDING CHAPTER 13 REGARDING ECONOMIC DEVELOPMENT ADVISORY BOARD Page 3 W:Richland Hills/Ordinance/Amendment of Chapter 13 Regarding Economic Development Advisory Boazd sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 7. PUBLICATION The City Secretary of the City of Richland Hills is hereby directed to publish this ordinance to the extent required by law. SECTION 8. EFFECTIVE DATE This ordinance shall be in full force and effect from and after its passage and publication as required by law, and it is so ordained.
