I,2l I ro i AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, REPEALING SECTION 1-17 " OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, DEFINING THE EXISTING CITY BOUNDARY AND ENACTING A NEW SECTION PERTAINING TO THE SAME SUBJECT. WHEREAS, pursuant to Section 71.012.2 RSMo, 1994,the City Council of the City of Jefferson was,on May 6, 1997 presented with a verified petition requesting that the city annex the unincorporated area of land described in Section 1. WHEREAS,the petition requesting said annexation was signed by all fee interests of record in all real property located within the area proposed to be annexed; and I 1 . WHEREAS,a public hearing concerning the annexation was advertised on May 16, 1997 in the Jefferson Cit y Post Tribune;and . NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,MISSOURI,AS FOLLOWS: Section 1. The City Council intends to and shall proceed to annex, as provided by law, the unincorporated area of land described as follows: Part of the East half of the Southwest quarter of Section 8, Township 44, Range 12, Cole County, Missouri,more particularly described as follows: From the iron pin at the southeast corner of the Southeast quarter of the Southwest quarter of said Section 8, Township 44, Range 12;thence North 6 degrees 44 minutes west, along the quarter section line, 1678.22 feet,to the beginning point of this description;thence continuing along said quarter section line, 1097.90 feet,to an iron pin set for the northeast corner of the Northeast quarter of the Southwest quarter of said Section 8; thence South 84 degrees 29 minutes west, 1342.11 feet,to a stone set for the northwest corner of the Northeast quarter of the Southwest quarter of said Section 8; thence South 6 degrees 36 minutes east, 1320.0 feet; thence North 84 degrees 29 minutes east,673.45 feet;thence North 66 degrees 04 minutes east, 702.1 feet, to the beginning point of this description. Containing approximately 39 acres. Section 2. The City Council finds and declares that the land described in Section 1 is contiguous to the City boundary; that the annexation is reasonable and necessary to the proper development of the City; and further, did determine the city has the ability to furnish normal municipal services to the area. The City shall provide primary service within the corporate limits of the City as I they exist on the date of this Agreement. The Fire District shall provide primary service within L` its boundaries as specified by this Agreement. !,r 2. This Agreement shall not affect the existing mutual aid agreement between the City and Fire District. 3. There have been diverse dealings and transactions between City and Fire District related to the method of calculating the amount of payments to which the Fire District is entitled under the Missouri statutes. Disputes and differences have arisen between the City and Fire District regarding this issue. The parties have agreed to settle the dispute and differences by the payment of Twenty-Eight Thousand Dollars($28,000.00)by City to the Fire District,as for City's statutory obligations,and by the execution of mutual releases. Said payment is to be made by City to the Fire District within 15 days of each parties' acceptance of this Agreement. , 4. In pursuance of this Agreement, and in consideration of Twenty-Eight Thousand Dollars ($28,000.00) upon execution of this Agreement to be paid by City to the Fire District, each of them, City and Fire District, releases the other, and the other's heirs, executors, administrators, estates, and effects, from all sums of money, accounts, actions, and all claims relative to these two(2)annexations of Ventura,City Ordinance No. I k-1 1-4- and Meadows By the Club, City Ordinance No. 16 5. The parties expressly reserve to themselves the right to continue to assert their positions in any future annexations involving the Regional West Fire Protection District. 6. If any subsection, sentence, clause, phrase, or other portion of this Agreement or its application is, for any reason,declared invalid in whole or in part by any Court,said decision i shall not affect the validity of the remaining portions thereof. 7. All notices required or permitted hereunder and required to be in writing may be given by first class mail addressed to the City of Jefferson,at 320 East McCarty Street,Jefferson City, Missouri, 65101, and Regional West Fire Protection District, 609 Apache Trail,Jefferson I' City, Missouri 65109.
