ORDINANCE NO,
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND
DISCONTINUING PARTS OF EXISTING SANITARY SEWER EASEMENTS FOR A
PORTION OF TRACT ONE AND TWO OF THE MOSERS SUBDIVISION AND ACROSS
A PART OF TRACT"A"OF DIAMONDS SUBDIVISION, SECTION SIX.
WHEREAS, by an easement recorded in Book 11, Page 829, of the Records of the Cole
County, Missouri, a sewer easement was granted to the City of Jefferson, a Municipal
Corporation, to excavate within, install, construct, maintain and repair structures for the
routing and conveyance of sewer in, under and through the lots, tracts or parcels of land
described in Section 1; and
WHEREAS, by an easement recorded in Book 11, Page 907, of the Records of the Cole
I County, Missouri, a sewer easement was granted to the City of Jefferson, a Municipal
Corporation, to excavate within, install, construct, maintain and repair structures for the
routing and conveyance of sewer in, under and through the lots, tracts or parcels of land
described in Section 2.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI,AS FOLLOWS:
Section 1. The Council finds that the following described easement is surplus
property of the City and is no longer needed for any public purpose:
A strip of land ten(10)feet wide across part of Tract 1 of MOSERS SUBDIVISION in the City of
Jefferson,as per plat of record in Plat Book 11,Page 829,Cole County Recorder's Office;said ten
(10)foot strip being situate in the South Half of the Southwest Quarter of Section 10,Township 44
North, Range 12 West and also first described in a"Sanitary Sewer Easement By Corporation"of
record in Book 333,Page 969,of the Cole County Recorder's Office;the centerline of said ten(10)
foot strip being more particularly described as follows:
From the northeast corner of Tract 1 of said MOSERS SUBDIVISION;thence S82°23'31"W along
the north line of said Tract 1,801.42 feet(800.52 feet by plat)to the POINT OF BEGINNING for this �.
centerline description; thence leaving said north line on a bearing of S35°49'09"E, 237.74 feet
(S35-56'1 8"E.237.29 feet by plat)to the POINT OF TERMINATION of this centerline description.
A strip of land ten(10)feet wide across part of Tracts 1 and 2 of MOSERS SUBDIVISION in the City
of Jefferson,as per plat of record in Plat Book 11, Page 829,Cole County Recorder's Office;said
ten(10)foot strip being situate in the South Half of the Southwest Quarter of Section 10,Township
44 North, Range 12 West and also secondly described in a "Sanitary Sewer Easement By
Corporation"of record in Book 333,Page 969,of the Cole County Recorder's Office;the centerline
of said ten(10)foot strip being more particularly described as follows:
i From the northeast corner of Tract 1 of said MOSERS SUBDIVISION;thence S05°35'43"E along
the east line of said MOSERS SUBDIVISION,370.00 feet;thence continuing along said east line
on a bearing of S27°40'23"E, 109.79 feet to the POINT OF BEGINNING for this centerline t
description; thence leaving said east line on a bearing of S07°24'27"W, 363.78 feet; thence
S40°08'52"W,300.00 feet to the POINT OF TERMINATION of this centerline description. I

Section 2. The Council finds that the following described easement is surplus j
property of the City and is no longer needed for any public purpose: I
A strip of land fifteen (15)feet wide across part of Tract"A"of THE DIAMONDS SUBDIVISION,
SECTION SIX,as per plat of record in Plat Book 11,Page 907,of the Cole County Recorder's Office;
said fifteen(15)foot strip being situate in the South Half of the Southwest Quarter of Section 10,
Township 44 North,Range 12 West and also described in a"Sanitary Sewer Easement"of record
In Book 386,Page 416,of the Cole County Recorder's Office;the centerline of said fifteen(15)foot i
strip being more particularly described as follows:
From northeasterly corner of said Tract "A";thence S72°00'39"W,7.99 feet along the northerly line
of said Tract"A"to the POINT OF BEGINNING for this centerline description;thence S02°08'28"W,
179.95 feet;thence S40°08'52"W,60.00 feet to the POINT OF TERMINATION for this centerline
description.
Section 3. The easements described in Sections 1 and 2 are hereby relinquished,
and the City does hereby release and abandon whatever interest it has in the easements.
Section 4. The Mayor and City Clerk are hereby authorized to execute any
necessary legal document relinquishing all of the City's interest in the tracts of ground
described in Sections 1 and 2.
. ISection 5. This Ordinance shall be in full force and effect from and after the date of
its passage and approval. -+
