BILL NO. 97-37 �. jl SPONSORED BY COUNCILMAN Jaynes ORDINANCE NO.__ AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, REPEALING AND RESCINDING SECTION 1 B OF ORDINANCE#11351 AND SECTION 1 OF ORDINANCE j #12157 RELATING TO THE CHANGING, AMENDING AND MODIFYING THE ZONING w MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, OF 2,0 ACRES (APPROXIMATELY) LOCATED 250 FEET NORTH OF MISSOURI BOULEVARD AND } EAST OF AND ADJACENT TO THE NORTHERLY EXTENSION OF BLAIR DRIVE BY RESCINDING THE ZONING CLASSIFICATION OF PUD PLANNED UNIT DEVELOPMENT AND REINSTATEMENT OF THE ZONING CLASSIFICATION OF RA-2 MULTIPLE FAMILY RESIDENTIAL . WHEREAS, IN ACCORDANCE WITH SECTION 35-86.1, JEFFERSON CITY ZONING CODE, AMENDMENT OF THE CHAPTER, IT APPEARS THAT THE DEVELOPER OF I A REZONED DISTRICT DID FAIL TO BEGIN CONSTRUCTION TO CONFORM TO THE NEW DISTRICT CLASSIFICATION WITHIN A PERIOD OF THIRTY (30) MONTHS FOLLOWING THE APPROVAL OF SAID DISTRICT BY THE COUNCIL;AND WHEREAS, THE REZONING OF THE SUBJECT PROPERTY TO C-2 GENERAL COMMERCIAL WAS APPROVED BY ORDINANCE#11351 SECTION 1 B, ON JANUARY 9, 1990;AND I WHEREAS,THE REZONING OF THE SUBJECT PROPERTY TO PUD PLANNED UNIT DEVELOPMENT WAS APPROVED BY ORDINANCE#12157 ON SEPTEMBER 19, 1994; 1 NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,AS FOLLOWS: SECTION 1. The rezonings approved under Ordinance #11351,Section 1B from RA-2 Multiple Family Residential to C-2 General Commercial,and and Ordinance#12157 i from C-2 General Commercial and PUD Planned Unit Development, be rescinded, and that RA-2 Mulitple Family Residential zoning be reinstated on the following described real estate: Beginning at a point on the northerly right-of-way line of old U.S. Highway 50 (Missouri Boulevard),which is 735.50 feet westerly from the east line of said Section 11 (measurement made along the northerly right-of-way line of old U.S. Highway 50); thence north parallel with the east line of said quarter section, and along the easterly line of a tract conveyed to Jacob W.
