' ` I AN ORDINANCE APPROVING AN AMENDED URBAN RENEWAL PLAN FOR PROGRESS URBAN RENEWAL PROJECT NO. MO. R-45("URBAN RENEWAL PLAN (AMENDED- 1997) ' BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: SECTION 1. The City Council hereby makes the following findings: a. It is desirable and in the public interest that the Housing Authority of the City of Jefferson (herein called the "Local Public Agency") undertake and carry out the urban renewal project(herein called the"Project") identified as"Progress Project Mo. The Local Public Agency has made or is making detailed studies of the location, physical condition of structures, land use, environmental influences and social, cultural and economic conditions of the Project area and has determined that the area was or is a blighted area and that it has been or is detrimental and a menace to the safety, health and welfare of the inhabitants and users thereof and of the Locality at large, because of defective, inadequate street layout; unsanitary, unsafe conditions; deterioration of site improvements; improper subdivision and ' obsolete platting; which together retard the provision of housing accommodation and constitute an economic and social liability and a menace to the public, health, safety and welfare in its present condition and use, and the members of this Governing Body have been fully apprised by the Local Public Agency and are aware of these facts and conditions. C. There has been prepared and referred to the City Council of the Locality (herein called the "Governing Body") for review and approval an amended urban renewal plan for the Project area, dated 1997 and consisting of Sixty-Two (62) pages and five ( 5 ) exhibits, supported by the following supplementary material, data and recommendations submitted in conjunction with that amendment, which material, data and recommendations are not part of the urban renewal plan: 1. Letter of Approval of the City Planning and Zoning Commission, indicating that the amended urban renewal plan does not.conflict with the general plan for the development of the community as a whole. 2. Letters of approval or acceptance by existing redevelopers within the project area or their successors in interest who are affected by the proposed modification. d. The Amended Urban Renewal Plan has been approved by the goveming body of the Local Public Agency, as evidenced by the copy of said body's duly certified resolution approving the amended Urban Renewal Plan, which is attache hereto. x e. A general plan has been prepared and is recognized and used as a guide for the general development of the Locality as a whale. f. The Planning and Zoning Commission, which is the duly designated and acting official planning body for the Locality, has submitted to the Governing Body +`^ its report and recommendations respecting the amended urban renewal plan for the t' " project area and has certified that the amended urban renewal plan confoims,to the general plan for the Locality, and the Governing body has duly considered the report; recommendations, and certification of the planning body. g. The amended urban renewal plan fbr the project area prescribes certain land uses for the project area and has required or will require, among other things, changes in zoning, the vacating and removal of streets, alleys and other public �XxH� ways, the establishment of new street patterns, the locations and relocation of sewer Bill 97-I 06/Page 3 1 I� i i >' and water mains and other public facilities, and other public action. 1'.I h. The Local Public Agency has not changed the previously approved program for the relocation of individuals and families that may be displaced as a result of carrying out the project in accordance with the amended urban renewal plan. i I. It is necessary that the Governing Body take appropriate official action i respecting the amended urban renewal plan for the project, in conformity with the contracts for financial assistance between the Local Public Agency and the United t i States of America, acting by and through the Secretary of the Housing and Urban { Development, and in conformity with the laws of the State of Missouri and the City of Jefferson. j. The Governing Body is cognizant of the conditions that are imposed in the undertaking and carrying out of urban renewal projects with Federal financial assistance under Title 1, including those prohibiting discrimination because of race, s color, creed, or national origin. i t k. The Project is or was a blighted, deteriorated and deteriorating area and qualifies as an eligible Project area under Section 99.320 Revised Statutes of Missouri. 1. The Objectives of the amended urban renewal plan cannot be achieved through more extensive rehabilitation of the project area. M. The amended urban renewal plan for the project area is feasible and conforms to the 9 eneral plan for the development of the community as a whole. ` I n. The financial. aid provided pursuant to the contracts for Federal financial l . assistance pertaining to the Project has been necessary to enable the project to be , undertaken in accordance with the amended urban renewal plan for project area. >. o, In addition to the elimination of slums and blight from the Urban Renewal Area, the undertaking of the Project in such area has promoted and will further promote the public welfare and the proper development of the community (a) by making land in such area available for disposition, for uses in accordance with the ; Urban renewal plan,for redevelopment in accordance with the use or uses specked ., ,y y in the Plan, and (b) by providing, through the redevelopment of the urban renewal {{tt area in accordance with the plan, cohesive environments within the Project area. P. The amended urban renewal plan for the urban renewal area will afford maximum opportunity, consistent with the sound needs of the Locality as a,whole, F for the urban renewal of the Area by private enterprise. ;. f y q. The existing program for the proper relocation of individuals and families displaced in carrying out the Project in decent, safe, and sanitary dwellings:in :.7 conformity with acceptable standards is and has been feasible and has been or can be reasonably and timely effected to permit the proper prosecution and completion. # of the Project; and that such dwellings or dwelling units available or to be made available to such displaced individuals and families are at least equal in number to i the number of displaced individuals and families, are not generally less desirable in regard to public utilities and public,and commercial facilities than the dwellings of the displaced individuals and families in the Project area, are available at rents or prices within the financial means of the displaced individuals and families, and are reasonably accessible to their places of employment. { SECTION 2. The amended urban renewal plan for the project, having been duly reviewed and considered, is hereby approved, and the City Clerk is hereby directed to file said copy of the amended urban renewal plan with the minutes of this meeting. SECTION 3. In order to implement and facilitate the effectuation of the amended urban renewal plan hereby approved, it is found and determined that certain official action may be ;'s necessary to be taken by this Body with reference, among other things, to changes in zoning, the vacating and removal of streets, alleys, and other public ways, the establishment of new street 1: - � 9 y R Y patterns, the location and relocation of sewer and water mains and other public facilities, and other public action, and accordingly, this Body hereby (a) pledges its cooperation in helping to carry out i the amended urban renewal plan; (b) requests the various officials, departments, boards, and agencies of the Locality having administrative responsibilities in the premises likewise to cooperate y'. ... to such end and to exercise their respective functions and powers in a manner consisdant with the amended urban renewal plan; and (c) stands ready to consider and take appropriate action upon proposals and measures designed to effectuate the amended urban renewal plan. j t SECTION 4. The major changes ` in this Amended Plan concern modified land use designations in conformity with the City's zong code and additions to the disposition tracts exhibit. B. DESCRIPTION OF PROJECT 3.. Urban Renewal BA an obJ12.9t�a The Housing Authority, hereinafter referred to as the "Agency, " herein proposes to redevelop the Progress Urban Renewal "Area, which is within an area generally, bounded on the north by the Missouri River and Adrian's Island, on the south by U.S. Highway 50-63, on the Ik east by Lafayette Street, and on the west by the U.S. Highway 54-63 j• ____ A•: right-of-way, all within the City of Jefferson, Missouri.. Acquisition of certain, real property, including improved or unimproved land, structures buildings, improvements, easements, and other rights in land, legal or equitable; except that owners may, if land is not designated for public use including public parking in the Plans elect to sell structures only and retain the land for redevelopment in accordance with the Plan; c. Demolition and/or removal of certain structures, buildings and improvements; d. Relocation assistance to businesses and to families who will be displaced by the Plan; e. Installation, construction and reconstruction of streets, utilities and other improvements including public parking necessary to accomplish the objectives of the applicable laws in accordance with the Plan; f. Land clearance activities on all Housing Authority-owned land will continue, except that :structures found to be eligible for inclusion on the National Register of Historic Places may be preserved for a reasonable period. to allow local historic I preservation groups or developers the opportunity to incorporate such structures into their development plans. The Amended Plan proposes no changes in the City's existing zoning, street and building codes.
