HomeMy Public PortalAboutOrdinance No. 971-03 09-23-2003 • ORDINANCE NO. 971-03 AN ORDINANCE AMENDING CITY OF RICHLAND HILLS ORDINANCE NO. 935-02 AND THE FISCAL YEAR 2002-03 BUDGET FOR THE CITY OF RICHLAND HILLS, TEXAS, ADOPTED THEREBY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Richland Hills, Texas, adopted Ordinance No. 935-02 on September 10, 2002, approving and adopting a municipal budget for the City of Richland Hills, Texas, for fiscal year 2002-03, and WHEREAS, changed conditions resulted in the adoption of Ordinance No. 953-03 on April 8, 2003 and Ordinance No. 963-03 on July 22, 2003 amending the budget adopted by Ordinance No. 935-02; and; WHEREAS, changed conditions and circumstances, which could not have been foreseen through the use of reasonably diligent thought and attention, have necessitated a certain amendment to Ordinance No. 935-02 and the budget adopted thereby; and WHEREAS, a public hearing on the following amendment to the fiscal year 2002-03 budget contemplated hereby has been held as required by law. • NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: 1. That Section III of said Ordinance No. 935-02 as amended to increase the enterprise fund appropriation from $2,837,607 to $3,944,484 with such increase allocated and appropriated as follows: $174,422 such sum the surplus from the 1998 Certificates of Obligation Issue, for transfer to the 1998 Certificates of Obligation Interest and Sinking Fund as required by said issuance ordinance for repayment of debt. $932,455 such sum the surplus from the 2002 Certificates of Obligation Issue, for transfer to the 2002 Certificates of Obligation Interest and Sinking Fund as required by said issuance ordinance for repayment of debt. • • II. That Section VI of said Ordinance 935-02 as amended is amended appropriating $268,093 out of the 1998 Certificate of Obligations Interest and Sinking Fund for the repayment of wastewater works general long-term debt principal and interest. III. That Section VIII of said Ordinance No. 935-02 as amended is amended appropriating $69,103 out of the 1998 General Obligations Interest and Sinking Fund for the repayment of general long-term principal and interest. IV. That Section X of said Ordinance No. 935-02 as amended is amended appropriating $1,115,820 out of the 1998 Certificates of Obligations issue for wastewater system improvements. V. That Section XIII of said Ordinance No. 935-02 as amended is amended • appropriating $230,147 out of the Road and Street Improvement Fund for street and roadway improvements. VI. That Section XVI of said Ordinance No. 935-02 as amended is amended appropriating $124,370 out of the 2001 Certificates of Obligation Interest and Sinking Fund for the repayment of general long-term principal and interest. VII. That Section XVI11 of said Ordinance No. 935-02 as amended is amended appropriating $736,394 from the 2001 Certificates of Obligation Issue for construction of Burns Road Improvements. VIII. That Section XX of said Ordinance No. 935-02 as amended is amended appropriating $6,631 out of the Municipal Court Technology Fund for the purpose of acquiring an automated hand held ticket writing machine and other technological equipment. • • IX. That Section XXI of said Ordinance No. 935-02 as amended is amended appropriating $34,778 out of the KRHB NCTCOG Grants for the purpose of implementing environmental clean-up programs. X. That Section IX of said Ordinance No. 935-02 as amended is amended appropriating $64,282 out of the 2001 contractual obligation expense fund for capital outlays in conjunction with capital equipment acquisition. XI. That Section XII of said Ordiance No. 935-02 as amended is amended appropriating $199,466 from the General Reserve Fund to Pay off long-term debt regarding Fire Truck Lease Purchase agreements. XII. That Section XXIV-A be created in said Ordinance No. 935-02 as amended is amended appropriating $32,407 out of the Special Programs (COPS • Grant) Fund for the employment of a School Resource Officer. XIII. That Section XXIV-B be created in said Ordinance No. 935-02 as amended is amended appropriating $957 out of the Law Enforcement Fund for the purchase of Police Equipment. XIV. That Section XXIV-B be created in said Ordinance No. 935-02 as amended is amended appropriately $15,114 out of the Library Grant TIFB/Lone Star Fund to purchase computer equipment and software books. • XX. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. XXI. Saving Clause. That Ordinance No. 935-02 of the City of Richland Hills, Texas, shall remain in full force and effect, save and except as amended by this ordinance. XXII. Effective Date. This ordinance shall be in #ull force and effect from and • after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
