AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, EXPANDING DEFENDANT REIMBURSEMENT FOR COST OF ARREST INVOLVING DWI AND BAG OFFENSES BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: WHEREAS, Section 19-12�of the Code of the City of Jefferson, Missouri, currently provides that upon a plea of guilty or a finding of a guilty for a first offense involving a violation of Driving While Intoxicated or Blood Alcohol Content, the Municipal Court may, in addition to other penalties provided by law, impose the costs associated with the arrest of the defendant upon the defendant as provided for by Section 577.048, RSMo, (1986); and �n WHEREAS, the Missouri Legislature has recently amended Section 537.048, RSMo. (1986), to expand the imposition of costs of arrests upon the defendant for any 4 offense, not just the first offense, involving a Driving While Intoxicated or Blood Alcohol Content violation. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF ' JEFFERSON, MISSOURI: Section 1. Section 19-12� of the Code of the City of Jefferson, Missouri, establishing a policy for Defendant reimbursement of costs of arrests for a DWI and BAC ; ` • violations shall be amended to read as follows: Section 19p12 . Court Costs. ! Upon a plea of guilty or a finding of guilty for an .offense of violating ` Sections 19-98, 19-99 or 19-100 of the Code of the City of Jefferson, the, Municipal Court may, in addition to imposition of any penalties provided by law, order the convicted person to reimburse the enforcement agency which made the arrest for the costs associated with such arrest. Such costs shall include the reasonable cost of making the arrest, including the cost of any chemical test made under this Chapter to determine the alcohol or drug content of the person's blood, and the costs of processing, charging, booking and holding such person in custody. The enforcement agency may establish a schedule of such costs; however, the Court may order the costs reduced if 1 it determines that the costs are.excessive.
