HomeMy Public PortalAboutOrdinance No. 973-03 10-14-2003 • ORDINANCE N0.973-03 AN ORDINANCE OF THE CITY OF RICHLAND HILLS, TEXAS EXPANDING MEMBERSHIP ON THE ECONOMIC DEVELOPMENT ADVISORY BOARD BY THE ADDITION OF A MEMBER OF THE CITY COUNCIL SERVING AS AN EX-OFFICIO MEMBER; CLARIFYING THE VOTING RIGHTS OF ALTERNATES OF THE BOARD; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR PUBLICATION AS REQUIRED BY LAW; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Richland Hills is a home rule city acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, the City Council has previously established by ordinance an Economic Development Advisory Board composed of 10 members plus 2 alternates, with any 3 not required to be registered voters of the City, but having business interests in the City; and WHEREAS, the economic development advisory board recommends to the City Council policy alternatives which will promote and enhance economic development while ensuring quality of • life in the city; recommends to the City Council policies which attract new businesses and assist existing businesses; recommends to City Council policies which encourage commercial development and redevelopment; coordinates, schedules, and hosts meetings of members of the business community in order to facilitate a positive relationship between the city and the business community; and establishes a data base of information relating to market characteristics, labor force, land availability, labor availability and capital availability in the city; and WHEREAS, the City Council has determined that adding a member of the City Council as an ex-officio member of the economic development advisory board would facilitate better communication and coordination between the Economic Development Advisory Board and the City Council; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: SECTION 1. Section 10-91 of Article III of Chapter 10 of the Richland Hills City Code is hereby amended to read as follows: There is hereby created the city economic development advisory board. • Members of the economic development advisory board shall be registered voters within the city on the date of their appointment, excepting three members who may • be persons not registered to vote within the city, but having business interest within the city. Any of such members having business interests in the city may, by written designation filed with the city manager, appoint a substitute of similar background and experience to attend one or more meetings of the economic development advisory board and, if so designated in writing, to vote by proxy in the member's place and stead. No member may serve in any capacity on more than one other city standing board, commission and committee, or any special committee exceeding six months' duration; or serve as city representative to a local, state or national organization, provided, however, that a City Council member serving as an ex-officio member of the economic development advisory board shall not be subject to these restrictions. All members shall serve without compensation. No debts of any kind or character shall be made or incurred by the economic development advisory board or by anyone acting in its behalf. SECTION 2. Section 10-92 (a) of Article III of Chapter 10 of the Richland Hills City Code is hereby amended to read as follows: The economic development advisory board shall be composed of five regular members who shall hold designated places 1, 2, 3, 4 and 5, along with two alternate members and two non-voting business members. Appointments shall be made by the • City Council. Each regular member shall be nominated by the councilmember holding the council seat or place corresponding to the numbered place of such regular member. Alternate members and non-voting business members shall be appointed at large and not by council place, and any councilmember may nominate persons for appointment as at-large alternate members and non-voting business members. All nominations for regular, alternate and non-voting business members shall be deemed approved unless rejected by the affirmative vote of four councilmembers. In addition, the City Council may appoint one of its members as an ex-officio member of the board by majority vote. Regular members shall serve for a term coinciding with the term of the councilmember who appointed such regular member, regardless of the date of appointment. Alternate members and non-voting business members shall serve for a term of two years from the date of their appointment. A City Council member appointed to the board as an ex-officio member will serve a term coinciding with that councilmember's term. Section 10-95 of Article III of Chapter 10 of the Richland Hills City Code is hereby amended by the addition of the following at the end of said section: In the absence of a regular member, the alternate member with the longest continuous service on the board present at the meeting shall be entitled to vote in the stead of the absent regular member. In the absence of two or more regular members, the other alternate member, if present at the meeting, shall also be entitled to vote in the stead of one of the absent regular members. The remainder of Section 10-95 shall remain unchanged. SECTION 4. PROVISIONS CUMULATIVE This ordinance shall be cumulative of all provisions of ordinances and of the Code of Ordinances of the City of Richland Hills, Texas, as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event the conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 5. • PROVISIONS SEVERABLE It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 6. PUBLICATION The City Secretary of the City of Richland Hills is hereby directed to publish this ordinance to the extent required by law. SECTION 7.
