"sh . AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING
-` EXECUTION OF DOCUMENTS TO MISSOURI, DECLARING CERTAIN
AUTHORITY OF THE CITY OF JEFFERSON,
CITY PROPERTY SURPLUS AND DIRECTING THE TRANSFER OF PROPERTY TO
THE LOCAL CHAPTER OF HABITAT FOR HUMANITY.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:

' r NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI:
Section 1. The Mayor and City Clerk are hereby authorized and directed to
enter into appropriate legal documents, including contracts for sale to obtain the
j � following property from the Housing Authority of the City of Jefferson, Missouri:

Lot Numbers 6 9, 11, 12, 16, 17 and 18 of Block 19; and Lot Numbers 6,
>> 7 and 8 of Block 24 of Washington Park Addition to the City of Jefferson,
Missouri, as per plat of record in Plat Book 2, at page 3, of the Cole
County Recorder's Office.
+ r Section 2. The amount paid for the property described in Section 1 shall not
exceed Ten Thousand Dollars ($10,0000.00).
Missouri, finds that the following
Section 3: The Council of the City of Jefferson,
real property is surplus property of the City, and as such represents a burdensome
cost, and that the property is no longer needed for any public purposes:
The tract of land belonging to the City located between My,tie Avenue on the
west, Colorado Street on the east and Pike Street on the south.
Section 4: The Mayor and City Clerk are hereby authorized to sell the property
" described in Section 3, upon approval of the Jefferson City Housing Authority, to
Habitat for Humanities.
Section 5. The Mayor and City Clerk are hereby authorized and directed to
execute any and all necessary documents to convey title to the property described in
Section 1 and Section 3 to the Jefferson City Chapter of Habitat for Humanity for the
purpose of fulfilling the Community Development Block Grant Application and to enable

THIS AGREEMENT, dated this 4fb day of _April 1994,
is by and between the Housing Authority of the City of
` Jefferson, State of Missouri, a municipal. corporation ("party
of the first part") , and the City of Jefferson, State of
Missouri, a municipal corporation ("part of the second part") . sw
WHEREAS, the party of the second part has determined it '
appropriate to purchase certain lots owned by the party of the
a first part for the public purpose of providing locations for

the construction of new low-cost housing, primarily as part of
the City' s flood relief efforts;
NOW, FOR AND IN CONSIDERATION of the mutual obligations

herein contained, the parties agree as follows :

1. The party of the first part agrees to sell and convey ;
' unto the party of the second part, and the party of the second
part agrees to purchase from the party of the first part upon
the terms and conditions hereinafter set forth, the following-
described real estate situated in the County of Cole, State of
Missouri, to-wit:
Lot Nos . 6, 9, 11, 12, 16, 17 and 18 of
Block 19; and Lot Nos. 6, 7 and 8 of Block 24 of
'& Washington Park Addition to the City of
Jefferson, Missouri, as per plat of record in
Plat Book 2, at Page 3, Cole County Recorder' s
Office.
together with any personal property which may be affixed
thereto.
2 . The price for said property shall be Ten Thousand
Dollars ($10, 000 . 00) to be paid by the party of the second part
upon the delivery of the deed from the party of the first part.

3 . The sale under this agreement shall be closed at City
Hall, 320 E. McCarty Street, Jefferson City, Missouri, on the
15th day of April, 1994, at 10: 00 a .m. or at such other time

and as the
p parties may mutually agree. Possession shall
be delivered to the party of the second part at the time of
closing.
4 . The purchaser acknowledges and agrees that it is
accepting the property in its "as is" condition, and that the
party of the first part is not required to do any work,

including demolition work, at the

5. It is understood and agreed that title herein required
to be furnished is marketable title as set forth in Title
Standard IV of the Missouri Bar.
6. The party of the first part shall deliver at closing a
special warranty deed free and clear from all liens and
encumbrances whatsoever except as herein provided, and the
party of the second part shall then and there
pay the balance
of the cash payment hereinbefore provided for.
IN WITNESS WHEREOF, the parties hereto have executed this
