" AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND DISCON- TINUING THE RIGHT-OF-WAY FOR A PORTION OF COLORADO STREET EXTENDING BETWEEN MYRTLE AVENUE AND PIKE STREET. WHEREAS, it has been shown to the Council of the City of Jefferson Missouri f , that owners of land adjacent to and abutting upon Colorado Street extending between Myrtle Avenue and Pike Street in the City, have requested the City Council to vacate right-of--way; and Ri ,r WHEREAS, it has further been shown that it would not inconvenience the public or the citizens of the City to discontinue a portion of the right-of-way of Colorado Street extending ;t between Myrtle Avenue and Pike Street for r' public use as described in Section 1 of this Ordinance; and ��rya WHEREAS, it has further been shown that it would not inconvenience the public or the ' Y at citizens of the City to discontinue a portion of the right-of-way for public use as described in Section 1 of this Ordinance, subject to a reservation in the City of ty an easement in that portion vacated for the maintenance, repair, location and relocation of all sanitary sewer, surface water sewer or public utility facilities now existing or hereafter to be constructed within said right-of- ' way. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Council of the City of Jefferson, Missouri, hereby declares it necessary, rea- sonable and proper to discontinue as a right-of-way a portion of Colorado Street extending be- tween Myrtle Avenue and Pike Street and forever vacate the following described right-of-way in said City: All that part of the right-of-way of Colorado Street which adjoins the westerly line of Block #19 of"Washington Park Addition" as filed for record in Plat Book #2, Page 3 of the Cole County Records, located in the Northwest Quarter of the Southeast Quarter of Section 12, Township 44 North, Range 12 West, City of Jefferson, Cole County, Missouri,more specifically described as follows: A strip of land 50 (fifty) feet wide adjoining the western side of Lots 10 thru 18 of said Block #19, said strip extends northerly from the southwest corner of said Lot 18, along the western line of said Lots 10 thru 18, a distance of 450.0 feet to the northwest corner of said Lot 10. 5 + ^ '-R J ry-�'}•'y' �vk. " �� Tv R. The City of Jefferson shall retain, however, all that portion of the Myrtle Street right-of-way that overlaps with the above-described part of Colorado Street. Sectio�2, That portion of the above vacated property described as follows is hereby retained as a perpetual easement or right-of--way for the construction, maintenance, repair, relocation and operation of sanitary sewers, surface water drainage, and all public utility facilities, and no per- manent buildings or structures shall be located within or upon said easement without the prior written consent of the City: r A strip of land adjoining the western line of Block #19 of "Washington Park a Addition" per Plat Book 2, Page 3 of the Cole County Records, located in the n Northwest Quarter of the Southeast Quarter of Section 12, Township 44 North, Range 12 West, City of Jefferson, Cole County, Missouri, more specifically described as follows: Beginning at the southwest corner of said Block #19, being also the southwest corner of Lot #18; thence northerly, along the west line of Lots 10 thru 18, 450.0 feet to the northwest corner of said Lot 10; thence westerly, on an extension of the north line of said Lot 10, 16.6 feet; thence southerly 450.0 feet to a point on the western extension of the south line of said Lot 18; thence easterly along said extended line, 32.0 feet to the point of Beginning. Section 3. The statutory right of reversion in the owners of the abutting property is hereby f confirmed, as is provided by the laws of the State of Missouri, and the Mayor and the Clerk of the City are hereby authorized to execute all necessary instruments required to confirm the rever- sionary rights of the owners of property abutting on the area vacated, as described in Section 1 of this ordinance, in the right-of-way vacated. Section 4. This Ordinance shall take effect and be in full force from and after its passage.
