Adoption of the BOCA National Plumbing Code 1993 Edition. z, The BOCA National Plumbing Code/1993, published by the Building Officials & Code Administrators International, Inc. is hereby adopted and incorporated herein by reference as the Plumbing Code of the City of Jefferson, #. with the additions, insertions, deletions and changes contained in this ordinance. ; x . Chapter 8 of the Code of the City of Jefferson, Missouri, is hereby further amended by repealing the present Section 8-5, entitled "Amendments to 1 Plumbing Code 1987," and enacting the following new Section 8-5, entitled "Amendments to BOCA National Plumbing Code 1,993": :. Sec. 8-5. Amendments to the BOCA National Plumbing Code 1993. The following addition, insertions, deletion and changes in the BOCA , National Plumbing Code 1993 and contained in Ordinance No. 12138, shall be t4 as set out below: A. P- 105.1.1 Qualifications of Plumbing Inspector: The Plumbing Inspector shall be over twenty-one (21) years of age, be of good moral character, and be l physically able to carry out all the provisions of the plumbing code. The ; Plumbing Inspector shall have six (6) years experience as a licensed journeyman in the trade, or have two (2) years training in a recognized college of { Mechanical Engineering and in addition thereto, shall have a minimum of four (4) r years of practical experience in plumbing construction. The Plumbing Inspector ; shall be a City of Jefferson licensed journeyman plumber, but shall not be { '' .. }k r55t4 actively engaged in the plumbing business, nor associated with the operation of # any person, firm or corporation engaged in the plumbing business. -105.2 Appointment of Plumbing Inspector: The Plumbing Inspector shall ~.. be appointed by the Mayor with consent of a majority of the members of City ' Council. Applicants for the position shall be interviewed by the Director ofs z Planning and Code Enforcement prior to confirmation and approval of the City Council. P-105.2.2 Duties of the Plumbing Inspector: It shall be the duty of the Plumbing Inspector to enforce the provisions of the plumbing code and to make ?' all inspections required thereunder, and to issue all permits, collect all fee's and K keep all records required under this ordinance. All fee's are to be credited to the General Revenue. The Plumbing Inspector shall also perform all tasks and services delegated by other ordinances, the Mayor, or other supervisory personnel. rf. B. Owner shall purchase all materials and perform all labor to complete the plumbing installation. All work performed under this permit will comply to all Sections of this Ordinance. P-109.1.3: No permit shall be issued until plans and specifications showing proposed work in necessary detail are submitted to the Plumbing Inspector and it is determined the work shall conform to all provisions of this ordinance. Delete Sections P-121.2, P-121.2.1, P-121.2.2, P-121.2.3, P-121.2.4, P-121.2.5, P-121.2.6, and P-121.3, and insert the following sections in their places: P-121.2 Board of Plumbing eview and Examiners Appointment ppointment and Term of Office: The Board of Plumbing Review and Examiners is hereby created. The Board shall consist of six (6) members; The Plumbing Inspector shall be ex- officio chairperson; the Director of Planning and Code Enforcement or a City Council person; Two (2) Master Plumbers that are actively engaged in the business of plumbing and two (2) Journeyman Plumbers. The last four (4) ; mentioned members shall be appointed by the Mayor with the consent of a majority of the members of City Council approval for a term of two (2) years and they shall serve until successors are duly appointed. The appointments shall be made every two (2) years and they shall serve without pay. I P-121.2.1 Duties of the Board: The Board shall act on grievances by an applicant for a plumbing permit, the holder of plumbing permit, or the owner z and/or agent of a building or structure wherein plumbing work is to be installed. Such grievances shall be an appeal of the decision of the Plumbing Inspector or r authorized agent or representative. Refusing to grant a modification of provision of the plumbing code governing the installations or materials to be used. Applications for appeal will be submitted to the Director of Planning and Code Enforcement or an authorized representative, when it is claimed that: a 1. The true intent of the plumbing code or rules adopted thereunder have been incorrectly interpreted. ; 2. The provisions of the plumbing code do not fully apply. At such time as the Board of Review and Examiners meet to act on such an appeal, the Plumbing Inspector shall not vote. If one of the members of said 3 Board is the appellant, that member shall not vote. A simple majority of those voting shall constitute a qualified decision. They shall transmit to City Council any and all recommendations and/or changes necessary to update the plumbing code, P-121.2.2 Meeting of the Board. P-121.2.3 Licenses: No person, firm or corporation shall install, repair alter, or extend any plumbing system within the City of Jefferson unless licensed as �£ and required in this ordinance. This license requires a ($10.00) ten dollar fee and is permanent unless revocated for cause. P-121.2.3.4 Apprentice Plumber License: Persons desiring a licehse to work as an apprentice plumber shall submit their name, address, phone number and social security number with the ($5.00) five dollar fee to the Plumbing Inspector. This license is renewable each calendar year. Holder of an apprentice plumber license may only work under the director supervision of a license master or journeyman plumber. The ratio of apprentices to journeyman or master is (2) two to (1) one. P-121.2.4 Licenses, Suspension or Revocation. The Board may suspend or revoke the license of any apprentice, journeyman, master or contractor plumber when charges are preferred against them by the Plumbing Inspector, and the Board finds the person charged is incompetent or had willfully violated the provisions of this ordinance. Prior to Board action, the person charged shall be given at least (10) ten days notice of the time and place of a formal hearing on j. said charges and the person charged shall be apprised of the charges. The person charged shall be given the opportunity to appear in person or with an attorney and shall have the burden of showing cause why the license should not be suspended or revoked. The Board shall render its decision within (5) five days. The decision shall be final, no appeal shall be allowed. The Board may drop the charges, suspend the license for such period deemed proper or permanently revoke the charged persons license. Persons whose license has been revoked shall not be permitted to apply for re-licensing for a period of one (1) year, and must successfully pass required examination for the license. P-121.2.6 Assignment of Contractor Licenses: No person licensed as a Plumbing Contractor shall allow this license to be used by others for the purpose of obtaining Plumbing Permits or knowingly allow non-licensed persons to do plumbing work. P-121.2.6 License Examinations: License Examination shall require a ($50-00) fifty dollar fee payable after approval of license application and prior to taking examination. The Board shall establish standards and procedures for examination. The examination shall be of a basic and elementary character but sufficiently strict to test the qualifications of the applicant. All examination shall be completed within (4) four hours. 6 o MMMM Y`A 1. Master Plumber License Examination shall test of the knowledge of plumbing theory, plumbing practices, water supply safety, and the City Plumbing Ordinance. 5 2. Journeyman License Examination shall be in (2) two parts: a) a test of knowledge of Plumbing Theory b) a test of skill in the practice of the trade e+ P-121.2.7 Re-Examination: Persons who fail to pass the examination as prescribed may apply for re-examination after the expiration of (120) one hundred twenty days. Should applicant fail on re-examination, the applicant may not re-apply for a period of (1) one year and shall be considered a new applicant. P-121.3 Plumbing Inspections; Powers & Limitations: 1. Right of entry: The Plumbing Inspector shall have the right, during ` reasonable hours, to enter any building in the discharge of official ` duties or for making an inspection. t t 2. The ordinance shall not be construed to relieve from or lessen the responsibility or liability of any persons owning, operating, , controlling or installing any plumbing or damaged cause by any Yt y defect therein, nor shall the City of Jefferson or any of its , inspectors, agents or employees, including its Plumbing Inspector, be held as assuming any such liability by reason of the inspection y. authorized herein or certificate of approval issued as herein provided. 3. Notice of Inspection; It shall be the duty of the permit holder to supply all materials and equipment required for all test and to arrange with the Plumbing Inspector for all inspections. The permit holder shall allow (24) twenty-four hours for the Plumbing Inspector to conduct the required inspections during the City's normal working hours. 4. Defective Plumbing; wherever the Plumbing Inspector finds a defect in any plumbing or work installed in violation of this or other- City ordinance, said defect or violation shall be ordered removed or corrected. Persons so notified who neglect to file an appeal or fail to comply with order given, or violate a . provision of the ordinance shall be deemed guilty of a =. misdemeanor and upon conviction thereof shall be punished by a fine of not more than ($500.00) five hundred dollars or by imprisonment not to exceed (180) one hundred eighty days or by both fine and imprisonment. Each day the y violation continues shall be deemed a separate offense. x E.
