In any and all procedures, hearings and appeals the burden of proof
%•t regarding compliance and qualification for a home occupational use of property
:, shall be on the person seeking or attempting to retain a home occupational use.
,1 Provided, however, that if an applicant supplies the information requested in
I , Article IVA a rebuttal presumption exists and the city staff shall issue a business
',• license to the applicant unless readily available contrary facts at the time of the

Any application required for any permit or license related to a home
occupation shall include at least the following information: 1) the first and last
'• ' name(s) of the persons operating the home occupation; 2) the specific nature of
r the home occupation; 3) the address of the residence to be used for said home
occupation; 4) whether or not the home occupation will involve the receiving of
clients or customers, and if so, the anticipated volume and frequency of the
'• same; and 5) the anticipated frequency of the deliveries related to the home
occupation.
Sec. 35-29. Appeals of Decisions Involving Home Occupations.
The Board of Adjustment shall hear the following cases involving Home
