(a) Developer shall, at its cost,prepare preliminary artistic plans and specifications for the , ' Development(the preliminary forms of such plans referred to as "Development Plans"). Within one 14;,4 hundred twenty (120) days after the Execution Date of this bk.:t ty Agreement, Developer shall submit the t' `„: ,4 preliminary Development; Plans for review and approval by the City, which approval shall not be k . unreasonably withheld or delayed. City shall make all reasonable efforts to approve or disapprove the asz`, V t34 Tans within sixty �'�` plans ixty (60) days after receipt. If the City does not approve or disapprove such plans by ��' k'3 resolution of the City Council within ninety(90)days after receipt,they shall be deemed approved for '`"'` all purposes under this Development Agreement. This approval procedure shall be applicable to all „' al Development Agreement, including, but not limited to, any future .`fr, approvals required under this Develo ment y )q, 1.1 material improvements constructed by Developer. Developer agrees to make timely application after licensing ,. approval of the Missouri Gaming Commission, for all necessary construction permits, licenses and t' ',. approvals including,without limitation,any with respect to hii torical sites,(individually and collectively f'' • referred to as"Construction Permits")from the U.S. Corps of Engineers,the U.S. Coast Guard, the U.S. Department of Interior,the U.S.Environmental Protection Agency,the Federal Emergency Management Agency,the State of Missouri or other governmental authorities with jurisdiction over the operations ' contemplated herein. . 4. 1.4. V i. i 3.4 Elements of Construction. r ".%.' (a) Developer agrees that construction of the Development will be subject to the following technical specifications and conditions.
