HomeMy Public PortalAboutOrdinance No. 0979-04 02-10-2004 • ORDINANCE NO. 979-04 AN ORDINANCE OF THE CITY OF RICHLAND HILLS, TEXAS REDUCING THE NUMBER OF MEMBERS ON THE RICHLAND HILLS PARKS AND BEAUTIFICATION ADVISORY BOARD; ELIMINATING THE ALTERNATE POSITIONS ON THE KEEP RICHLAND HILLS BEAUTIFUL COMMISSION; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Richland Hills is a home rule city acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, the City Council of the City of Richland Hills has previously authorized the creation of a Parks and Beautification Advisory Board, and provided that said board shall be composed often members; and WHEREAS, the City Council has now determined that said Board is too large, and makes • it difficult for the City Council to find qualified citizens willing to devote the time and attention necessary to fulfill the purposes of said Board, and needlessly increases the difficulty of making a quorum for meetings of said Board; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: SECTION 1. Section 10-242 of Article VIII of Chapter 10 of the Richland Hills City Code is hereby amended to read as follows: Composition, appointments and terms of members. (a) The parks and beautification advisory board shall be composed of five regular members who shall hold designated places 1, 2, 3, 4, and 5, and two alternate members, who shall hold designated places A-a and A-b. Each councilmember shall • be entitled to nominate persons to serve as regular members of the parks and • beautification advisory board in the numbered place corresponding to the numbered place on the city council held by such councilmember. Any councilmember shall be entitled to nominate persons to serve as alternate members. All nominations shall be approved unless rejected by the affirmative vote of four councilmembers. The term of regular members shall coincide with the respective councilmember term, and the term of alternate members shall be two years from the date of appointment. b) The city staff representative to the board shall be the director of public works or a representative designated by the city manager. The mayor shall designate one councilmember annually to serve as anon-voting, ex officio member of the parks and beautification advisory board. SECTION 2. Section 1G-243 of Article VIII of Chapter 10 of the Richland Hills City Code is hereby amended to read as follows: Sec. 10-243. Vacancies; unexpired terms. Any vacancy occurring in the regular membership of the parks and beautification advisory board shall be filled by appointment in the same manner as • provided for appointment of members for frill terms, and such appointee shall serve for the remainder of the unexpired term of the member whose place becomes vacant, regardless of whether such person previously served as an alternate member. The parks and beautification advisory board may submit to the city council recommendations of persons qualified to fill such vacancies. SECTION 3. Section 10-245 of Article VIII of Chapter 10 of the Richland Hills City Code is hereby amended to read as follows: Sec. 10-245. Meetings, rules of procedure and quorum. The parks and beautification advisory board shall hold meetings regularly at least once each month at a time and place designated by the majority vote of the members. The parks and beautification advisory board shall, in matters of procedure, be governed by Robert's Rules of Order, Newly Revised, and may adopt such additional rules of procedure as it may deem necessary. A quorum for the transaction of business shall be that number which is more than half the currently appointed regular members, regardless of whether alternate members are currently serving. This ordinance shall be cumulative of all provisions of ordinances and of the Code of Ordinances of the City of Richland Hills, Texas, as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event the conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 5. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 6. This ordinance shall be in full force and effect from and after its passage, and it is so ordained. PASSED AND APPROVED ON THIS l ~ DAY OF ~e~ , 2004.
