AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND
DISCONTINUING A PORTION OF AN ALLEY IN THE MARY H. BURCH SUBDIVISION.
i; WHEREAS, it has been shown to the Council of the City of Jefferson, Missouri, that
the owners of laced adjacent to and abutting upon an alley in the Mary H. Burch Subdivision
{' 1 in the City, have petitioned the City Council to vacate alley; and

WHEREAS, it has further been shown that it would not inconvenience the public or
the citizens of the City to discontinue a portion of an alley for public use as described in
Section 1 of this Ordinance; and ;

WHEREAS, it has further been shown that it would not inconvenience the public or
the citizens of the City to discontinue a portion of the alley for public use as described in
Section 1 of this Ordinance, subject to a reservation in the City of an easement in that "
}r . portion vacated for the maintenance, repair, location and relocation of all sanitary sewer,
r surface water sewer or public utility facilities now existing or hereafter to be constructed ;es
within said alley.

G NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Council of the City of Jefferson, Missouri, hereby declares it
w'.. necessary, reasonable and proper to discontinue as a alley and forever vacate the following
described alley in said City:
Part of a 13 foot 9 inch wide north/south alley adjacent to Lot Nos.
' 6, 7, 8, and 12 of the Mary H. Burch Subdivision of Outlot No. 4 �#
i of the City of Jefferson as per plat of record in Plat Book 1, Page `
89, of the Cole County Recorders Office; being more particularly
described as follows:
BEGINNING at the southwest corner of said Lot No. 12, said
corner being on the north line of Franklin Street; thence westerly
along the north line of said Franklin Street, 13 feet 9 inches to the x
southeast corner of said Lot No. 8; thence north along the east
lines of said Lot Nos. 8, 7, and 6, 151 feet 5 inches to a point 10
feet south of the northeast corner of said Lot No. 6; thence
easterly and parallel to the northerly fine of said Franklin Street,
