HomeMy Public PortalAboutORD12329 2 i BILL NO. 95-60 PASSED AS AMENDED SPONSORED BY COUNCILMAN Niles and Bertel ORDINANCE NO. 12329 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CALLING AN ELECTION y UPON THE ISSUE OF LICENSING OF EXCURSION GAMBLING BOATS AND FLOATING FACILITIES IN THE CITY. t WHEREAS, the citizens of the City of Jefferson approved riverboat gambling in November of 1992, at two subsequent statewide votes on riverboat gambling issues the citizens within the corporate limits rejected the statewide propositions; and 8 WHEREAS, the facts surrounding the operation of riverboat gambling have become clearer with the passage of time; and WHEREAS, the laws regulating riverboat gambling have been amended since ° November of 1992; and WHEREAS, the best method to determine the position of the City is to submit the issue to the voters. a f NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: y 1, Section 1. The following proposition is hereby submitted to the qualified voters of , ll the City of Jefferson and shall be voted upon at an election as hereinafter provided. The :+ ; I question shall read in words and figures substantially as follows: PROPOSITION A '> ' Shall the City of Jefferson allow the licensing of excursion gambling boats or floating facilities, as now or hereafter provided by Missouri gaming law, in the City of Jefferson? Yes ❑ H No ❑ Section 2. If you are in favor of the question, place an "X" in the box opposite"Yes." 'x If you are opposed to the question, place an "X" in the box opposite "No." 1 Section. If a majority of the qualified voters voting at said election shall vote in ar r favor of the approval of this ordinance, then the same shall be binding in full force and effect from and after such approval. Section 4. If any section, subsection, sentence, clause, phrase, or portion of this A ordinance is for any reason held invalid or unconstitutional by any court of competent z t jurisdiction, such portion shall be deemed a separate, distinct and independent provision, 1 Po P F as such holdings shall not affect the validity of the remaining portion thereof. t4 „j1 Section 5. The City Clerk shall prepare and execute the form of the Notice of said election and shall transmit the same to the Election Authority for the City of Jefferson, Missouri, and request said election be conducted by law. Section 6. If a majority of the votes cast on a question by the qualified voters voting t thereon are in favor of the question, then the City Clerk, upon receipt of the election Y certificate from the Election Authority, shall certify the results of such election to the Secretary of State of the State of Missouri and to the State Gaming Commission. 11 34 R Section 7.
