HomeMy Public PortalAboutOrdinance No. 0997-04 09-28-2004 ORDINANCE NO. 997-04 DINANCE AMENDING CITY OF RICHLAND HILLS ORDINANCE NO. 969-03 AN OR AND THE FISCAL YEAR 2003-04 BUDGET FOR THE CITY OF RICHLAND HILLS, TEXAS, ADOPTED THEREBY; PROVIDING A SEVERABiLITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Richland Hills, Texas, adopted Ordinance No. 969-03 on September 9, .2003, approving and adopting a municipal budget for the City of Richland Hills, Texas, for fiscal year 2003-04 and WHEREAS, changed conditions resulted in the adoption of Ordinance No. 978- 04 on January 27, 2004 and Ordinance IVo. 989-04 on July 13, 2004, amending the budget adopted by Ordinance No. 969-03; and WHEREAS, changed conditions and circumstances, which could not have been foreseen through the use of reasonably diligent thought and attention, have necessitated a certain amendment to Ordinance No. 969-03 and the budget adopted thereby; and WHEREAS, a public hearing on the following amendment to the fiscal year 2003-04 budget contemplated hereby has been held as required by law. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY • OF RICHLAND HILLS, TEXAS: That Section 111 said Ordinance No. 969-03 as amended be amended to increase the enterprise fund appropriation from $2,817,207 to $3,670,375 with such increase allocated and appropriated as follows: $50,429 such sum the surplus #rom the 1998 Certificates of Obligation Issue, for transfer to the 1998 Certificates of Obligation Interest and Sinking Fund as required by said issuance ordinance for repayment of debt; $802,739 such sum the surplus from the 2002 Certificates of Obligation Issue for transfer to the 2002 Certificates of Obligation interest and Sinking Fund as required by said issuance ordinance for repayment of deb#. II. That Section VI of said Ordinance No. 969-03 as amended be amended appropriating $274,243 out of the 1998 Certificate of Obligations Interest and Sinking Fund for the repayment of wastewater works general long-term debt principal and interest. nl. That Section XV of said Ordinance No. 969-03 as amended be amended appropriating $126,099 out of the 2001 Certificate of Obligations Interest and Sinking Fund far the repayment of general long-term debt principal and interest. IV. That Section XVI of said Ordinance No. 969-03 as amended be amended appropriating $47,033 out of the Equipment Replacement Fund for the purchase of vehicles and equipment. V. That Section XVII of said of said Ordinance No. 969-03 as amended be amended appropriating $19,013 out of the Municipal Court Technology Fund for the purpose of acquiring computers, software and other technological equipment. VI. That Section XX-A be created in said Ordinance No. 969-03 as amended be amended appropriating $10,155 out of the Library Grants TIFB/Lone Star Fund for the purpose of purchasing computers and software for the Library. Vlt. • That Section XX-B be created in said Ordinance 969-03 as amended be amended appropriating $4,581 from the 2001 Certificates of Obligation Issue to fund construction of fencing related to Bums Street reconstruc#ion project. Vlll. That Section XX-C be created in said Ordinance 969-03 as amended be amended appropriating $41,531 from the FEMA Grant Fund to fund the acquisition of fire prevention trailer and associated equipment for the Fire Department. . IX. Severabtility Clause. That it is hereby declared to the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this of this ordinance shalt be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. X. Saving Clause. That said Ordinance 969-03 of the City of Richland Hills, Texas, shall remain in full force and effect, save and except as amended by this ordinance. Xl. Effective Date. This ordinance .shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
