AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND DISCONTINUING A STREET RIGHT-OF-WAY ON A PORTION OF TYLER STREET. 9 WHEREAS, it has been shown to the Council of the City of Jefferson, Missouri, that the owners of land adjacent to and abutting upon a portion of Tyler Street in the City, have ` petitioned the City Council to vacate a street right-of-way; and ' WHEREAS, it has further been shown that it would not inconvenience the public or the citizens of the City to discontinue a portion of a street right-of-way for public use as described in Section 1 of this Ordinance; and 4 WHEREAS, it has further been shown that it would not inconvenience the public or ` the citizens of the City to discontinue a portion of the street right-of-way for public use as TA described in Section 1 of this Ordinance, subject to a reservation in the City of an easement ;r in that portion vacated for the maintenance, repair, location and relocation of all sanitary, sewer, surface water sewer or public utility facilities now existing or hereafter to be constructed within said street right-of-way. ' NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF s' JEFFERSON, MISSOURI, AS FOLLOWS: Bectior 1. The Council of the City of Jefferson, Missouri, hereby declares it '... necessary, reasonable and proper to discontinue as a street right-of-way and forever vacate ' the following described street right-of-way in said City: ' ,b Part of the thirty (30)foot wide right-of-way of Tyler Street between Jackson Street and Adams Street, as per the plat of record of "WOODCREST", an Addition to the City of Jefferson, in Plat Book 3, Page 2, of the Cole County f Recorder's Office; said part of the right-of-way of said Tyler Street being ' more particularly described as follows: ?2 BEGINNING at the southeasterly corner of Lot 78 of said Woodcrest Addition, said comer being the intersection of the northerly line of Tyler Street ' and the westerly line of Jackson Street; thence westerly along the southerly line of said Lot 78, said southerly line also being the northerly line of Tyler Street, 212 feet to the southwesterly comer of said Lot 78, said corner being the intersection of the northerly line of Tyler Street with the easterly line of a 19 foot wide north-south alleyway as per the plat of Woodcrest Addition; thence southerly along the southerly extension of the easterly line of said 19 fi ppq of � 1, y r�.� r 7 r• e9 .n "r r 'Z +r {�. �i•, 5} G�r t' 1 ?r _.j+l`. A rF foot wide alleyway, 30 feet to a point on the northerly line of Lot 79 of said << Woodcrest Addition, said northerly line also being the southerly line of Tyler Street; thence easterly along the northerly line of said Lot 79, 212 feet to the Y` northeast corner of said Lot 79, said corner being the intersection of southerly line of Tyler Street with the westerly line of Jackson Street; thence northerly along the westerly line of Jackson Street 30 feet to the POINT OF BEGINNING. All of that portion of the above vacated property is hereby retained as a perpetual easement or right-of-way for the construction, maintenance, repair, relocation cn;? and operation of sanitary sewers, surface water drainage, and all public utility facilities, and no permanent buildings or structures shall be located within or upon said easement without the rior written consent of the City. 1 t : Section 3 The statutory right of reversion in the owners of the abutting property is hereby confirmed, as is provided by the laws of the State of Missouri, and the Mayor and the Clerk of the City are hereby authorized to execute all necessary instruments required ' to confirm the reversionary rights of the owners of property abutting on the area vacated, . as described in Section 1 of this ordinance, in the ::rest right-of-way vacated, subject to the 5 easement retained in Section 2. Section 4. This Ordinance shall take effect and be in full force from and after its passage.
