HomeMy Public PortalAboutOrdinance No. 0001-05 11-17-2005 CCPD ORDINANCE NO. 0001-05 • AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE RESULTS OF A SPECIAL ELECTION HELD IN THE CITY OF RICHLAND HILLS, TEXAS, ON NOVMEBER 8, 2005, FOR THE REDUCTION OF THE CURRENT ONE HALF OF ONE PERCENT (0.5%) SALES AND USE TAX ALLOCATED TO THE RICHLAND HILLS ECONOMIC DEVELOPMENT CORPORATION BY THREE-EIGHTHS OF ONE PERCENT (0.375%) TO ONE-EIGHTH OF ONE PERCENT (0.125%), THE CREATION OF THE RICHLAND HILLS CRIME CONTROL AND PREVENTION DISTRICT DEDICATED TO CRIME REDUCTION PROGRAMS AND THE ADOPTION OF A PROPOSED LOCAL SALES AND USE TAX AT A RATE OF THREE-EIGHTHS OF ONE PERCENT (0.375%). WHEREAS, an election was held in the City of Richland Hills, Texas on the 8T" day of November 2005, at which there was submitted to the duly qualified voters of the City of Richland Hills, Texas, for their action and vote a proposition to determine whether the current one half of one percent (0.5%) sales and use tax allocated to the Richland Hills Economic Development Corporation should be reduced from three-eighths of one percent (0.375%) to one-eighth of one percent (0.125%), and to approve or disapprove the creation of the Richland Hills Crime Control and Prevention District dedicated to crime reduction programs and the adoption of a proposed local sales and use tax at a rate of three-eighths of one percent (0.375%) pursuant to the provisions of Section 383 of the Texas Local Government Code; and WHEREAS, it is hereby found and determined that notice of the election was duly given in the form, manner and time required by law, and said election was in all respects legally held and • conducted in accordance with applicable laws of the State of Texas and the proceedings calling and governing the holding of such election; and WHEREAS, the returns of said election have been duly and legally made and submitted to the Richland Hills Crime Control and Prevention District Temporary Board of Directors for canvassing, and a tabulation of the returns for the polling place and for early voting, as canvassed and tabulated by this governing body and shown in Exhibit "A"attached hereto, reflect that the total sum of votes counted voting "FOR" and "AGAINST" on the proposition submitted were as follows: PROPOSITION The reduction of the current one half of one percent (0.5%) sales and use tax allocated to the Richland Hills Economic Development Corporation bythree-eighths of one percent (0.375%) to one-eighth of one percent (0.125%), the creation of the Richland Hills Crime Control and Prevention District dedicated to crime reduction programs and the adoption of a proposed local sales and use tax at a rate of three- eighths of one percent (0.375%). RECITALS FOUND TRUE All of the recitals contained in the preamble of this ordinance are found to be true and are adopted as findings of fact by this governing body and as a part of its judgment. SECTION 2. ELECTION CANVASSED AND DECLARED EFFECTIVE It is further found and determined that the results of the election are as canvassed and tabulated in the preamble hereof and in Exhibit "A" attached hereto, and a majority of the resident qualified electors voting at said election have voted in favor of the proposition. SECTION 3. CITY SECRETARY TO RECORD ELECTION RESULTS The City Secretary is hereby authorized and directed to make the appropriate entries of information appearing in the tabulation of precinct results shown in Exhibit "A"attached hereto in the election register maintained by the City in accordance with provisions of Section 67.006 of the Election Code. • SECTION 4. CITY STAFF TO TAKE NECESSARY ACTIONS TO GIVE EFFECT The City Manager, City Secretary, and City Attorney are hereby authorized and instructed to take all actions necessary to give effect to this ordinance and the election, as provided by law. SECTION 5. EFFECTIVE DATE This ordinance shall be effective upon its adoption. Passed and approved this 17th day of November 2005.
