HomeMy Public PortalAboutOrdinance No. 1007-05 02-15-2005 • ORDINANCE NO. 1007-OS AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE SPECIAL ELECTION DETERMINING WHETHER THE CITY SHOULD ADOPT A FREEZE OF AD VALOREM PROPERTY TAXES ON RESIDENTIAL HOMESTEADS FOR DISABLED PERSONS AND PERSONS SIXTY-FIVE (65) YEARS OF AGE OR OLDER, SAID ELECTION HELD FEBRUARY 5, 2005. WHEREAS, an election was held in the City of Richland Hills, Texas on the 5th day of February, 2005, for the purpose of submitting a proposition to determine whether the taxes paid to the City on the homesteads of persons sixty five (65) years of age or older or who are disabled should never be increased; and WHEREAS, it is hereby found and determined that notice of the election was duly given in the form, manner and time required by law, and said election was in all respects legally held and conducted in accordance with applicable laws of the State of Texas and the proceedings calling and governing the holding of such election; and WHEREAS, the returns of said election have been duly and legally made and submitted to the City Council for canvassing, and a tabulation of the returns for the polling place and for early voting, as canvassed and tabulated by this governing body and shown in Exhibit "A" attached hereto, • reflect that the total sum of votes counted voting "Yes" and "No" on the proposition submitted were as follows: PROPOSITION Shall the total amount of taxes paid to the City on the homesteads of persons sixty five (65) years of age or older or who are disabled never be increased as provided by Article 8, Section 1-b(h) of the Texas Constitution? Early Votes Yes - 392 Election Day Votes Yes - 319 Total Votes Yes - 711 Early Votes No - 46 Election Day Votes No - 117 Total Votes No - 163 Undervotes Early - 1 Election Day Undervotes - 0 Undervotes Total - 1 Total Early Votes Cast - 439 Total Election Day Votes Cast - 436 Total Votes Cast - 875 Number of votes by which proposition passed: 548. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE TOWN OF RICHLAND HILLS, TEXAS: • • SECTION 1. RECITALS FOUND TRUE All of the recitals contained in the preamble of this resolution are found to be true and are adopted as findings of fact by this governing body and as a part of its judgment. SECTION 2. ELECTION CANVASSED AND DECLARED EFFECTIVE It is further found and determined that the results of the election are as canvassed and tabulated in the preamble hereof and in Exhibit "A" attached hereto, and a majority of the resident qualified electors voting at said election have voted in favor of the proposition, and the total amount of taxes paid to the City on the homesteads of persons sixty five (65) years of age or older or who are disabled are ordered never to be increased as provided by Article 8, Section 1-b(h) of the Texas Constitution. SECTION 3. CITY SECRETARY TO RECORD ELECTION RESULTS The City Secretary is hereby authorized and directed to make the appropriate entries of information appearing in the tabulation of precinct results shown in Exhibit "A" attached hereto in the election register maintained by the City in accordance with provisions of Section 67.006 of the • Election Code. SECTION 4. CITY STAFF TO TAKE NECESSARY ACTIONS TO GIVE EFFECT The City Manager, City Secretary, and City Attorney are hereby authorized and instructed to take all actions necessary to give effect to this resolution and the election, as provided by law. SECTION 5.
