ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELINQUISHING A CERTAIN
EASEMENT FOR SANITARY SEWER PURPOSES ON PROPERTY LOCATED AT 3400 NORTH
TEN MILE DRIVE.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,MISSOURI, AS FOLLOWS:
WHEREAS, by an easement recorded in Book 271, Page 139, of the Records of the Cole County,
Missouri, a sewer easement was granted to the City of Jefferson, a Municipal Corporation, to f r
excavate within, install,construct, maintain and repair structures for the routing and conveyance of
sewer in, under and through the lots,tracts or parcels of land described in Section 1;
Section 1. The Council finds that the following described easement is surplus property of the
City and is no longer needed for any public purpose:
A strip of land ten (10) feet of even width across part of the Southeast Quarter of
Section 4,Township 44 North,Range 12 West,in the City of Jefferson,County of Cole,
Missouri;said ten(I o)foot strip lying five(5)feet either side of a centerline being more
particularly described as follows:
From the southeast corner of said Section 4;thence N01°30'E,along the Section Line,
2788.50 feet to the northeast corner of the Southeast Quarter of said Section 4;thence
N87°25'W along the quarter section line, 868.84 feet; thence leaving said quarter
section line on a bearing of S02 002'07"W,30.66 feet;thence N87°57'53"W,34.27 feet
to an existing manhole at Station 21+73.95,Line"B"of the Extension of Private Sewer
No. 382, the POINT OF BEGINNING for this centerline description;7tfeet to
N86'1 9'26"W,along the centerline of the existing Sanitary Sewer Line,
an existing manhole at Station 23+09.83(Bk)=Station 22+45.80(Ah),Line"B"of the
Extension of Private Sewer No.382;thence S30°59'28"W,along the centerline of the
existing Sanitary Sewer Line,79.93 feet to Station 23+26.72, Line"B"of the Extension
of Private Sewer No.382,the POINT OF TERMINATION of this centerline description,
r excepting therefrom any portion of a fifteen (15)foot wide sanitary sewer easement
granted as per Book 378,Page 681,of the records of the Cole County Recorder.
Section 2. The ease ent a des rrinterestit has n the easeme tinquished, and the City does
hereby release and abandon
Section 3. The Mayor and City Clerk are hereby authorized to execute any necessary legal
document relinquishing all of the City's interest in the tract of ground described in Section 1.
Section 4. This Ordinance shall be in full force and effect from and after the date of its
passage and approval.
