ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELINQUISHING A
CERTAIN EASEMENT FOR SANITARY SEWER PURPOSES ON PROPERTY LOCATED
AT 804 BOONVILLE ROAD.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
WHEREAS, by an easement recorded in Book 238, Page 779, of the Records of the Cole
County, Missouri, a sewer easement was granted to the City of Jefferson, a Municipal
Corporation, to excavate within, install, construct, maintain and repair structures for the
routing and conveyance of sewer in, under and through the lots, tracts or parcels of land
described in Section 1;
Section 1. The Council finds that the following described easement is surplus
property of the City and is no longer needed for any public purpose:
A strip of land ten (10) feet of even width across part of the Northwest '
Fractional Quarter of Section 35,Township 45 North, Range 12 West, in the
{ City of Jefferson,County of Cole, Missouri, as described in Book 238, Page
779, of the Cole County Recorder's Office; said ten (10)foot strip lying five
(5) feet either side of a centerline being more particularly described as
follows:
From a point on the southerly line of the Public Road, known as Boonville
i Road, said point being 3.82 chains east of the west line, and 76.42 chains
north of the south line of said Section 35;thence N04°00'W,46.0 feet to the
northerly line of said Boonville Road;thence along the northerly line of said
Boonville Road, S48°28'E, 95.0 feet; thence S35009'E, 289.3 feet; thence
S32°27'E, 179.5 feet; thence S47014'E, 84.5 feet;thence S58°45'E, 217.45
feet; thence S62°38'E, 757.2 feet to the southwesterly corner of a tract of
land as described in Book 361, Page 262, of the Cole County Recorder's
Office; thence N28°17'E, along the westerly line of said tract, 62.45 feet to
the existing sanitary sewer line at Station 4+60.91 of Private Sewer No.301,
Line "B", the POINT OF BEGINNING for this centerline description; thence f
S77°38'40"E,along the existing sanitary sewer line,78.01 feet to the easterly
line of said tract in Book 361, Page 262,at Station 5+38.92 of Private Sewer
No. 301, Line "B", the POINT OF TERMINATION of this centerline
description, excepting therefrom any portion of a fifteen (15) foot wide
sanitary sewer easement granted as per Book 378,Page 830,and Book 378,
Page 831 of the records of the Cole County Recorder.
Section 2. The easement described in Section 1 is hereby relinquished,and the City
does hereby release and abandon whatever interest it has in the easement.

Section 3. The Mayor and City Clerk are hereby authorized to execute any
necessary legal document relinquishing all of the City's interest in the tract of ground
described in Section 1. ;
;j Section 4. This Ordinance shall be in full force and effect from and after the date of
its passage and approval.
