HomeMy Public PortalAboutOrdinance No. 1008-05 02-22-2005 ORDINANCE NO. 1008-OS AN ORDINANCE OF THE CITY OF RICHLAND HILLS, TEXAS AUTHORIZING THE CITY MANAGER TO EXPAND THE CONTRIBUTION OPTION ON THE CITY'S UTILITY BILL TO PERMIT CITIZENS TO CONTRIBUTE TO ANY OR ALL OF THE FOLLOWING: THE PARKS AND BEAUTIFICATION FUND, ANEWLY-CREATED ANIMAL SHELTER FUND, AND ANEWLY-CREATED LIBRARY FUND; AMENDING THE POWERS OF THE ANIMAL SHELTER ADVISORY BOARD AND THE LIBRARY ADVISORY BOARD TO INCLUDE RECOMMENDING EXPENDITURES FROM SUCH FUNDS; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR PUBLICATION AS REQUIRED BY LAW; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Richland Hills is a home rule city acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, the City has previously implemented a process whereby the citizens may contribute one dollar to the City Parks and Beautification Fund by paying an extra dollar with their monthly utility payment; and WHEREAS, such contribution program has been successful in raising needed funds for the improvement and maintenance of the City parks; and WHEREAS, the Council has determined That t animal shelter and the library are also services which are valued by the citizens, and which would benefit from inclusion in this program; and WHEREAS, the Council has determined that this program should be expanded, and the citizens given an opportunity to donate up to one dollar each to the Parks and Beautification Fund, a newly-created Animal Shelter Fund, and anewly-created Library Fund; and WHEREAS, the Council has determined that, like the Parks and Beautification Commission, the Animal Shelter Advisory Board and the Library Advisory Board should be empowered to recommend to the City Council expenditures from the newly-created Animal Shelter Fund and the newly-created Library Fund, respectively; • • NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: SECTION 1. The City Manager and City Finance Director are authorized to create a Library Fund for the purpose of operating, maintaining, improving, and expanding the Library and its resources, and an Animal Shelter Fund for the purpose of operating, maintaining, improving, and expanding the Animal Shelter. SECTION 2. Section 10-38 of Article II of Chapter 10 of the Richland Hills City Code is hereby amended to provide as follows: Section 10-218. Powers and Duties. The powers and duties of the Animal Shelter Advisory Board are as follows: (1) To advise the City Council on all matters pertaining to the animal shelter of the city; • (2) To make recommendations to the City Council regarding the annual budget of the animal shelter, and the expenditure of funds from the Animal Shelter Fund and other donations dedicated to supporting, operating, maintaining, improving, and expanding the animal shelter. (3) To assist the City Council in the development of the city's five-year capital improvements plan regarding any matters related to the animal shelter. (4) To promote community appearance and to stimulate public interest therein, and to solicit to the fullest extent possible from all civic groups, other public agencies and private organizations their cooperation, support and assistance in the improvement of animal shelter facilities. (5) To recommend to the City Council improvements and revisions to animal control ordinances, programs, fee structures and shelter needs as it may deem necessary. (6) When requested by the City Council, investigate, initiate, plan and complete projects on the operation, development and improvements of animal shelter facilities, and coordinate all projects for the improvement of the animal shelter. Page 2 • SECTION 3. Section 10-218 of Article VII of Chapter 10 of the Richland Hills City Code is hereby amended to provide as follows: Section 10-218. Powers and Duties. The powers and duties of the Library Advisory Board are as follows: (1) To advise the City Council on all matters pertaining to the library of the city; (2) To make recommendations to the City Council regarding the annual budget of the library, and the expenditure of funds from the Library Fund and other donations dedicated to supporting, operating, maintaining, improving, and expanding the library. (3) To assist in the development of the city's five-year capital improvements plan regarding any matters related to the library. (4) To promote community appearance and to stimulate public interest therein, and to solicit to the fullest extent possible from all civic groups, other public • agencies and private organizations their cooperation, support and assistance in the improvement of library facilities. (5) To recommend to the City Council general rules and regulations governing the use of the library. (6) When requested by the City Council, investigate, initiate, plan and complete projects on the operation, development and improvements of library facilities, and coordinate all projects for the improvement of the library. SECTION 4. Section 86-419 is hereby added to Article VIII of Chapter 86 of the Richland Hills City Code, which section shall provide as follows: Section 86-419. Donations through Utility Billing. The City Manager and City Finance Director are authorized to modify City's utility billing format and procedures to provide utility account holder the opportunity to donate up to one dollar each to the Parks and Beautification Fund, the Library Fund, and the Animal Shelter Fund, when paying their monthly utility bill. The • donations received from such utility billing process shall be dedicated to the specific Fund or Funds to which the paying utility account holder designates. Page 3 • SECTION 5. PROVISIONS CUMULATIVE This ordinance shall be cumulative of all provisions of ordinances and of the Code of Ordinances of the City of Richland Hills, Texas, as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event the conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 6. PROVISIONS SEVERABLE It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 7. PUBLICATION • The City Secretary of the City of Richland Hills is hereby directed to publish this ordinance to the extent required by law. SECTION 8.
