AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND DISCONTINUING THE RIGHTS-OF-WAY FOR PORTIONS OF MILLBROOK DRIVE, WEATHERED ROCK DRIVE, STONE HILL ROAD AND A PORTION OF MILLBROOK SUBDIVISION. WHEREAS, it has been shown to the Council of the City of Jefferson, Missouri, that the owners of land adjacent to and abutting upon Millbrook Drive,Weathered Rock Drive,Stone Hill i Road and a portion of Millbrook Subdivision in the City,have petitioned the City Council to vacate right-of-way;and WHEREAS, it has further been shown that it would not inconvenience the public or the citizens of the City to discontinue a portion of the right-of-way of Millbrook Drive,Weathered Rock Drive,Stone Hill Road and a portion of Millbrook Subdivision for public use as described in Section 1 of this Ordinance;and I I WHEREAS, it has further been shown that it would not inconvenience the public or the , citizens of the City to discontinue a portion of the rights-of-way for public use as described in i Section 1 of this Ordinance. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,AS FOLLOWS: Section 1. The Council of the City of Jefferson, Missouri, hereby declares it necessary, reasonable and proper to discontinue as a right-of-way a portion of and forever vacate the following described right-of-way in said City: • MILLBROOK DRIVE Part of a sixty(60)foot wide right-of-way, known as"MILLBROOK DRIVE"as per the plat of record of"MILLBROOK SUBDIVISION"in Plat Book 8, Page 109, of the Cole County Recorder's Office, said subdivision being a part of the southeast quarter of Section 24, Township 44 North, Range 12 West,in the City of Jefferson,County of Cole,Missouri;said right-of-way being more particularly described a follows: BEGINNING at the southwest corner of Tract"E"of said Millbrook Subdivision,said corner being on the north line of said Millbrook Drive;thence SO4°24'37"E along the west line of said Millbrook Subdivision, 89.69 feet to the northwest corner of Tract"G"of said Millbrook Subdivision, said corner being on the south line of said Millbrook Drive; thence easterly i along the south line of said Millbrook Drive on a curve to the left having a radius of 263.31 feet, an arc distance of 143.10 feet; thence leaving said south line on a bearing of N04 042'59"E, 60,00 feet to the aforementioned north line of said Millbrook Drive;thence westerly along the north line of said Millbrook Drive on a curve to the right having a radius of 203.31 feet,an arc distance of 169.27 feet to the POINT OF BEGINNING. • WEATHERED ROCK DRIVE j i Part of a sixty(60)foot wide right-of-way, known as"WEATHERED ROCK DRIVE"as per the plat of record of"MILLBROOK SUBDIVISION"in Plat Book 8, Page 109, of the Cole County Recorder's Office, said subdivision being a part of the southeast quarter of Section 24,Township 44 North, Range 12 West,In the City of Jefferson,County of Cole, Missouri; said right-of-way being more particularly described a follows: BEGINNING at the southwest corner of Tract"G'of said Millbrook Subdivision, said corner being on the north line of said Weathered Rock Drive;thence SO4°24'37"E along the west line of said Millbrook Subdivision, 60.00 feet to the northwest corner of Tract"I"of said Millbrook Subdivision,said corner being on the south line of said Weathered Rock Drive; r, thence easterly along the south line of said Weathered Rock Drive the following courses: N85°35'23"E, 50.00 feet; on a curve to the right having a radius of 453.45 feet, an arc mom distance of 185.00 feet; S71°02'10"E,194.69 feet;on a curve to the left having a radius of 432.09 feet,an arc distance of 250.84 feet;thence leaving said south line on a bearing of N14-17-51"W,60.00 feet to the aforementioned north line of said Weathered Rock Drive; thence westerly along said north line the following courses:on a curve to the right having a radius of 372.09 feet, an arc distance of 216.01 feet; N71°02'10"W, 194.69 feet; on a i curve to the left having a radius of 513.45 feet, an arc distance of 209.45 feet; S85°35'23"W,50.00 feet to the POINT OF BEGINNING. • STONE HILL ROAD Part of a sixty(60)foot wide right-of-way, known as"STONE HILL ROAD"as per the plat l of record of"MILLBROOK SUBDIVISION"in Plat Book 8, Page 109, of the Cole County I Recorder's Office, said subdivision being a part of the southeast quarter of Section 24, Township 44 North,Range 12 West,in the City of Jefferson,County of Cole, Missouri;said iright-of-way being more particularly described a follows: BEGINNING at the northwest corner of Tract"H"of said Millbrook Subdivision,said corner t. also being the intersection of the south line of Weathered Rock Drive and the east line of 1► Stone Hill Road;thence southerly,easterly,and northerly along the easterly, northerly and westerly lines of said Stone Hill Road the following courses:S06°40'08"W,492.58 feet;on a curve to the left having a radius of 131.28 feet, an arc distance of 230.99 feet; N85°51'20"E, 391.99 feet; on a curve to the left having a radius of 164.26 feet, an arc distance of 343.30 feet; thence leaving said westerly line on a bearing of N56°04'20"E, 60.00 feet to the easterly line of said Stone Hill Road; thence southerly, westerly, and northerly along the easterly, southerly, and westerly lines of said Stone Hill Road the following courses: on a curve to the right having a radius of 224.26 feet, an arc distance of 468.84 feet;S85°51'20"W, 391.99 feet;on a curve to the right having a radius of 191.28 feet,an arc distance of 336.56 feet;N06°40'08"E, 505.66 feet to a point, said point being the intersection of the west line of said Stone Hill road with the south line of the aforementioned Weathered Rock Drive; thence N71°02'10"E along the south line of said Weathered Rock Drive, 61.41 feet to the POINT OF BEGINNING. • TEN (10)FOOT WIDE UTILITY EASEMENTS i , The ten (10) foot utility easements as noted on the plat of record of "MILLBROOK j SUBDIVISION"in Plat Book 8,Page 109,of the Cole County Recorder's Office,that lie on ... The statutory right of reversion in the owners of the abutting property is hereby confirmed,as is provided by the laws of the State of Missouri,and the Mayor and the Clerk of the City are hereby authorized to execute all necessary instruments required to confirm the reversionary rights of the owners of property abutting on the area vacated,as described in Section 1 of this ordinance,in the right-of-way vacated. Section 3. This Ordinance shall take effect and be in full force from and after its passage.
