Jf�� AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND DISCONTINUING A PORTION OF A RIGHT-OF-WAY OF THE CUL-DE-SAC AT THE EASTERLY END OF HAAF DRIVE,AND A PORTION OF A UTILITY EASEMENT ON LOT 8 OF CHASE WOODS ADDITION. , WHEREAS, it has been shown to the Council of the City of Jefferson, Missouri,that the owners of land adjacent to and abutting upon a cul-de-sac right-of-way at the easterly j end of Haaf Drive, and a portion of a utility easement on Lot No. 8 of Chase Woods Addition in the City, have petitioned the City Council to vacate right-of-way; and WHEREAS, it has further been shown that it would not inconvenience the public or the citizens of the City to discontinue a portion of right-of-way for public use as described in Section 1 of this Ordinance; and WHEREAS, it has further been shown that it would not inconvenience the public or the citizens of the City to discontinue a portion of the right-of-way for public use as described in Section 1 of this Ordinance, subject to a reservation in the City of an easement in that portion vacated for the maintenance, repair, location and relocation of all sanitary sewer, surface water sewer or public utility facilities now existing or hereafter to be I constructed within said alley. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF ti.. JEFFERSON, MISSOURI,AS FOLLOWS: f Section 1. The Council of the City of Jefferson, Missouri, hereby declares it necessary, reasonable and proper to discontinue as a right-of-way and forever vacate the ' I following described right-of-way in said City: 1) Haaf Drive cul-de-sac right-of-way to be vacated } A part of the cul-de-sac right-of-way at the easterly end of Haaf Drive,as per the plat of record of Haaf Addition,as per Plat Book 5, Pages 18 and i 19,of the Cole County Recorder's Office;being more particularly described ! as follows: BEGINNING at a point on the westerly line of Lot No.8 of Chase Woods Addition, as per plat of record in Plat Book 11, Page 215, of the Cole County Recorder's Office,said point being the intersection of the southerly I ` Bill 96-1031 Page 1 1 ' I + a I A i line of Haaf Drive and the easterly line of Chase Woods Court; thence N35°56'27"W along the northerly extension of the easterly line of said Chase Woods Court,50.00 feet to a point,said point being the Intersection i of said northerly extension with the northerly line of said Haaf Drive;thence S54'11 5'32"W along said northerly line, 20.83 feet to southeasterly corner of Lot No. 19 of said Haaf Addition;thence on a curve to the right having a radius of 50.00 feet,an arc distance of 235.62 feet;thence S54'1 5'32"W, 29.00 feet to the POINT OF BEGINNING. 2) Utility Easement to be retained on a portion of vacated cul-de-sac right-of-way E A ten (10) foot wide easement for the purpose of installing and the maintaining of utilities across a part of the cul-de-sac right-of-way at the easterly end of Haaf Drive,as per the plat of record of Haaf Addition,as per Plat Book 5,Pages 18 and 19,of the Cole County Recorder's Office;being more particularly described as follows: BEGINNING at a point on the westerly line of Lot No.8 of Chase Woods Addition, as per plat of record in Plat Book 11, Page 215, of the Cole County Recorder's Office,said point being the intersection of the southerly line of Haaf Drive and the easterly line of Chase Woods Court; thence N35°56'27"W along the northerly extension of the easterly line of said Chase Woods Court,50.00 feet to a point,said point being the intersection of the said northerly extension with the northerly line of said Haaf Drive; thence S54°15'32"W along said northerly line,20.83 feet to southeasterly corner of Lot No.19 of said Haaf Addition; thence on a curve to the right having a radius of 50.00 feet, an arc distance of 10.07 feet; thence i. N54°15'32"E, 29.78 feet, thence S35°56'27"E, 60.00 feet; thence S54°15'32"W,10.00 feet to the POINT OF BEGINNING. 3) Utility Easement to be vacated Part of a ten(10)foot wide utility easement across a part of Lot 8 of Chase Woods Addition as per plat of record in Plat Book 11,Page 215,of the Cole County Recorders Office;being more particularly described as follows: From the most southerly corner of said Lot No.8 of Chase Woods Addition, as per plat of record in Plat Book 11, Page 215, of the Cole County Recorder's Office,thence N35 156'27"W along the westerly line of said Lot No.8,55.00 feet to a point,said point being the intersection of the southerly line of Haaf Drive and the easterly line of Chase Woods Court;thence N54'1 5'32"E along the southerly line of said Haaf Drive, 10.00 feet to the r POINT OF BEGINNING for this description; thence continuing N54°15'32"E, 19.00 feet;thence on a curve to the left having a radius of 50.00 feet,an arc distance of 85.32 feet to the northerly line of said Lot No. 8;thence N46°29'19"E along said northerly line, 10.00 feet;thence on a curve to the right having a radius of 60.00 feet,an arc distance of 102.38 feet;thence S54 115'32"W,18.97 feet;thence N35°56'27"W, 10.00 feet to the POINT OF BEGINNING. Section 2. All of that portion of the above vacated property is hereby retained as a perpetual easement or right-of-way for the construction, maintenance, repair, relocation and operation of sanitary sewers,surface water drainage,and all public utility facilities,and Bill 96-103/Page 2 t MM •f. 4 LL no permanent buildings or structures shall be located within or upon said easement without ' ' J the prior written consent of the City. i r I .. Section 3. The statutory right of reversion in the owners of the abutting property is hereby confirmed, as is provided by the laws of the State of Missouri,and the Mayor and the Clerk of the City are hereby authorized to execute all necessary instruments required ! to confirm the reversionary rights of the owners of property abutting on the area vacated, as described in Section 1 of this ordinance, in the alley vacated,subject to the easement retained in Section 2. Section 4. This Ordinance shall take effect and be in full force from and after its passage.
