IaP AN ORDINANCE OF THE CITY OF JEFFERSON MISSOURI TRANSFERRING LAND �= AND ESTABLISHING PORTIONS OF NORTH JEFFERSON CITY AS PARK PROPERTY. WHEREAS,following the flood of 1993,the City Council of the City of Jefferson has in the long-term best interest of the City authorized the acquisition of residential and commercial property in north Jefferson City as a part of a Comprehensive Flood Hazard Mitigation Program; and WHEREAS,along with City funds,the City of Jefferson has requested and received assistance through the Federal Emergency Management Agency 404 Buyout Program and j the Community Development Block Grant Program for acquisition of flooded lands and demolition of damaged structures; and WHEREAS, conditions of assurance for the receipt and use of Federal financial assistance requires reuse of acquired properties consistent with sound flood plain land j- management and use as defined in Title 44, Code of Federal Regulations, Part 77, including perpetual dedication and public use for open space purposes including community parks, greenways, trail corridors, river access points, picnic grounds, campgrounds, nature preserves, and community gardens, and WHEREAS,the City of Jefferson has successfully pursued and continues to pursue �. the Flood Buyout Program to the degree that acquisition is substantially completed in north Jefferson City, and WHEREAS, the City of Jefferson desires to initiate reuse of certain acquired I properties later herein described in compliance with federal requirements and special warrant deed restrictions. NOW THEREFORE, BET IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,AS FOLLOWS: Section 1. That real property acquired by the City through the Flood Buyout Program and related efforts located within an area bounded by Cedar City Drive (Old Highway 63), U.S. Highway 63-54,Water Street,the corporate limits,Teal Street,and Sixth Street, be and hereby are designated for public park purposes.The boundaries are shown on Exhibit A, attached hereto. :z 1' Mir— Section 2. That the Mayor and Clerk are authorized to execute any documents necessary to carry out the intent of this ordinance and specifically to execute the deed attached hereto as Exhibit B. q. Section 3. That the properties within the boundaries set out in paragraph 1 are i hereby transferred to the Parks and Recreation Commission of the City of Jefferson,which 1 is further charged with responsibility for their care in accordance with Article VI, Section 6.2, Paragraph B of the Charter of the City of Jefferson, Missouri. ; Section 4.
