ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AN AMENDMENT TO THE STATE BLOCK
GRANT AGREEMENT WITH THE MISSOURI DEPARTMENT OF TRANSPORTATION
FOR AIRPORT RUNWAY LIGHTING PROJECT.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
Section 1. The Mayor and City Clerk are hereby authorized and directed to execute
an amendment to the State Block Grant Agreement with the Missouri Department of
Transportation for airport lighting project No.AIR 935-40B/AIR 9353-40B.
Section 2. The amendment shall be substantially the same in form and content

as that amendment attached hereto as Exhibit A.
Section 3. This Ordinance shall be in full force and effect from and after the date of
its passage and approval.

AMENDMENT TO STATE BLOCK GRANT AGREEMENT
AMENDMENTS
THIS AMENDMENT is entered into by the Missouri Highway and Transportation
Commission (hereinafter, "Commission") and the City of Jefferson (hereinafter,
"Sponsor").

WHEREAS, the parties entered into this Agreement executed by the Sponsor on
September 8, 1994, and executed by the Commission on September 16, 1994,
(hereinafter, original Agreement) under which the Commission granted the sum not to
exceed $102,600.00 to the Sponsor to assist in replacing lighting system on runway
b. 12/30; and

WHEREAS, the Commission previously approved funds for replacing lighting
system on runway 12/30; and
WHEREAS, the level of funding originally approved is not sufficient to cover the
costs associated with replacing lighting system on runway 12/30; and

1 WHEREAS, the Commission has sufficient funds to increase the grant amount
for replacing lighting system on runway 12/30;
NOW, THEREFORE in consideration of these mutual covenants, the parties
agree as follows:
(1) The Commission grants to the Sponsor an additional sum not to exceed
$18,650.00 for replacing lighting system on runway 12/30 subject to the following
conditions:
(A) The Sponsor shall
p provide matching funds of not less than
$2,072.00 toward the project in addition to those previously committed by the Sponsor
in the original Agreement.

N (B) The project will be carried out in accordance with the assurances

(Exhibit
( t 1) given by the Sponsor to the Commission as specified in the original
Agreement.

(C) This Amendment shall expire and the Commission shall not be
jobligated to pay any part of the costs of the project unless this grant amendment has
been executed by the Sponsor on or before January,26, 1997, or such subsequent date
as may be prescribed in writing by the Commission, 9,1-
w�. (D) Based upon the revised project schedule, the original project time r
period of November 30, 1995, will be extended to February 28, 1997, to allow for
completion of the work. Paragraph 3 of the original Agreement is hereby amended
accordingly.
(E) All other terms and conditions of the original Agreement entered
into between the parties shall remain in full force and effect.

foregoing grant Agreement and the actions taken by said Sponsor and Sponsor's

respects due and proper and in accordance with the laws of the said state

Airport and Airway Improvement Act of 1982, the Airport and Airway Safety and
Capacity Expansion Act of 1987, the Aviation Safety and Capacity Expansion Act of
1990, and the Federal Aviation Administration Authorization Act of 1994. In addition,
for grants involving projects to be carried out on property not owned by the Sponsor,
there are no legal impediments that will prevent full performance by the Sponsor.
Further, it is my opinion that the said grant constitutes a legal and binding obligation of
