ORDINANCE NO. I,2 -7
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING A TWENTY
FOOT WIDE NORTH-SOUTH ALLEY AND PART OF DUNKLIN STREET LYING SOUTH
OF MISSOURI BOULEVARD, NORTH OF WASHINGTON PARK, AND WEST OF
VIRGINIA STREET IN JONES ADDITION TO THE CITY OF JEFFERSON.
WHEREAS, it has been shown to the Council of the City of Jefferson, Missouri, that j
the owners of land adjacent to and abutting upon a twenty foot wide north-south alley and
part of Dunklin Street lying south of Missouri Boulevard, north of Washington Park, and
west of Virginia Street in Jones Addition to the City of Jefferson, in the City, have
petitioned the City Council to vacate alley;and
WHEREAS, it has further been shown that it would not inconvenience the public or
the citizens of the City to discontinue a portion of an alley for public use as described in
Section 1 of this Ordinance;and

WHEREAS, it has further been shown that it would not inconvenience the public or
the citizens of the City to discontinue a portion of the alley for public use as described in
Section 1 of this Ordinance, subject to a reservation in the City of an easement in that
portion vacated for the maintenance, repair, location and relocation of all sanitary sewer,
surface water sewer or public utility facilities now existing or hereafter to be constructed
within said alley.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI,AS FOLLOWS:
Section 1. The Council of the City of Jefferson, Missouri, hereby declares it
necessary, reasonable and proper to discontinue as a alley and forever vacate the following
j described alley in said City:
All that part of a twenty(20)foot wide north-south alley and part of Dunklin Street
lying south of the south line of Business Route 50(Missouri Boulevard), north of
Washington Park, east of Lot Nos.40,41,42,43,and 44, and west of Lot Nos.35,
36,37, 38,and 39,all in Jones Addition to the City of Jefferson as per plat of record
in Plat Book 1,Page 110,Cole County Recorder's Office,said Jones Addition being
a subdivision of the southwest part of the Northeast Quarter of Section 12,Township
44 North,Range 12 West, in the City of Jefferson, County of Cole,Missouri; being
more particularly described as follows: I

BEGINNING at the southeast corner of Lot No. 40 of said Jones Addition;thence I
NO3°58'06"E along the east lines of Lot Nos.40,41, 42,43, and 44 of said Jones
Addition,the west line of said 20 foot north-south alley,230.00 feet to the northeast

corner of said Lot No. 44, thence continuing NO3°58'06"E along the northerly
extension of the west line of said alley,said extension also being the east line of that
v part of Dunklin Street previously vacated by Ordinance No. 4281of the City of
Jefferson,27.50 feet to the south line of said Missouri Boulevard; thence east along
the south line of said Missouri Boulevard on a curve to the left having a radius of
i 2040.01 feet, an arc distance of 20.31 feet(the chord bearing being S76°01'20"E j w
and the chord being 20.31 feet)to the intersection of the northerly extension of the !
east line of the aforementioned 20 foot north-south alley with the south line of said
Missouri Boulevard, said extension also being the west line of that part of Dunklin
Street previously vacated by Ordinance No. 6070 of the City of Jefferson; thence
leaving the said south line of Missouri Boulevard on a bearing of S03°58'06"W along
said northerly extension,23.90 feet to the northwest corner of Lot No. 35 of said
Jones Addition;thence continuing S03°58'06"W along the west lines of Lot Nos.35,
36,37,38,and 39,the east line of said 20 foot north-south alley, 230.00 feet to the
southwest corner of said Lot No.39;thence N86°14'44"W,20.00 feet to the POINT
OF BEGINNING.
} Containing in all,5113.58 square feet.

Section 2. All of that portion of the above vacated property is hereby retained as a
perpetual easement or right-of-way for the construction, maintenance, repair, relocation
and operation of sanitary sewers,surface water drainage,and all public utility facilities,and
no permanent buildings or structures shall be located within or upon said easement without
the prior written consent of the City.
Section 3. The statutory right of reversion in the owners of the abutting property is
hereby confirmed, as is provided by the laws of the State of Missouri, and the Mayor and
! the Clerk of the City are hereby authorized to execute all necessary instruments required
to confirm the reversionary rights of the owners of property abutting on the area vacated,
as described in Section 1 of this ordinance, in the alley vacated, subject to the easement
retained in Section 2. -
i Section 4. This Ordinance shall take effect and be in full force from and after its
i passage.
