AN ORDINANCE OF THE CITY OF JEFFERSON,MISSOURI,AMENDING CHAPTER 5 OF THE
CODE OF THE CITY OF JEFFERSON, MISSOURI BY ENACTING A NEW ARTICLE III, KEEPING f .
NUMEROUS ANIMALS RELATING TO THE NUMBER OF DOGS AND CATS PERMITTED AT A
+ RESIDENCE WITHIN THE CITY.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,MISSOURI,AS FOLLOWS:
Section 1. Chapter 5 of the Code of the City of Jefferson, Missouri is hereby amended by
enacting a new article to be known as Article III,Keeping Numerous Animals,which shall read as
follows:
ARTICLE III. KEEPING NUMEROUS ANIMALS
Sec.5-70. Limitation upon the number of animals.
A. Number of dogs allowed without permit.
It shall be unlawful at any time to keep,harbor or own at any one location within the city more
than four(4)dogs over the age of three(3)months. This provision shall not apply to animals
under the age of three(3)months nor to animals kept at a lawfully operated commercial kennel,
small animal hospital or city animal shelter.
B. Number of cats allowed without permit
t✓ It shall be unlawful at any time to keep,harbor or own at any one location within the city more
than five(5)cats over the age of three(3)months. This provision shall not apply to animals
under the age of three(3)months nor to animals kept at a lawfully operated commercial kennel,
small animal hospital or city animal shelter.
Sec.5-71. Permit required for animals in excess of limitation.
A. Animals allowed with permit.
Any person may apply to the Director of Planning and Code Enforcement or his designee for
a permit to keep,harbor or own more animals at one location than are allowed in Section 5-70
within the City.
B. Application for permit.
Application for permit to own dogs or cats In excess of the numbers allowed in section 5-70 shall
be made by the owner on a form to be provided by the Department of Planning and Code
Enforcement. The application for permit shall be accompanied by payment of a processing fee
in the amount of ten dollars($10.00).
C. Criteria considered.
In deciding whether to issue a permit,the Department of Planning and Code Enforcement shall
consider:
1. The conditions In which the animals are found;
2. Whether there have been previous complaints concerning the proper care,
~"y control,confinement or restraint of any animal or animal nuisance;

4• Whether the custodian of any animal shall have been convicted of any animal
related offense under municipal or state law within five(5)years;
+ 5• Whether all animals for which the permit is being obtained have been
inoculated against rabies within the last two(2)years;
6. Any other criteria related to the care and custody of animals and the impact
on surrounding property and neighbors.
Sec.5-72. No permit allowed.
No permit shall be issued to any person who has been convicted of any animal related offense under
• municipal or state law within the five(5)years preceding the date of the application
Sec.5-73. Revocation of permit.
Any permit issued pursuant to this ordinance shall be revoked whenever the Department of Planning
and Code Enforcement finds that 1)the conditions in which the animals are found are unsanitary,dangerous
or offensive;2)there are unresolved complaints concerning the proper care,control,confinement or restraint
Of any animal or animal related nuisance;3)the facilities are inadequate;or 4)the custodian of any animal shall
have been convicted of any animal related offense under municipal or state law within five(5)years. Upon
revocation of a permit the number of animals kept at the location shall comply with this ordinance within thirty i.

Sec.5-74. Appeals

e circuit court for review in the manner provided in Chapter 536,RS an
Section 5-75. Violation,Penalty.
When animals in excess of the limits established in this article are found at any location,the person
having control and possession of the premises shall be given notice that a violation exists, The notice shall inform
the person that the number of animals shall be reduced to comply with this article within thirty(30)days of the
I date of the notice. If no person is on the premises to personally receive the notice,the notice shall be attached i
to the premises in a reasonably visible location. In the event the person keeping the animals in violation of this
article fails to reduce the number of animals within thirty(30)days of the date of the notice,a fine of ten dollars
($10,00)per day for each animal exceeding the limit established in this article shall be imposed.
Section 2. This Ordinance shall be in full force and effect on and after May 1, 1997.
