The Mayor and City Clerk are hereby authorized and directed to execute an amendment to the 5309 Capital Assistance Agreement with Missouri Highway and Transportation Commission. Section 2. The amendment shall be substantially the same in form and content as that amendment attached hereto as Exhibit A. Section 3. Approved: 9/96(RMH) Revised: 11/96 (RMH) Modified: FIRST AMENDMENT TO THE MISSOURI HIGHWAY AND TRANSPORTATION COMMISSION 5309 PUBLIC TRANSIT CAPITAL ASSISTANCE GRANT AGREEMENT I THIS AMENDMENT is entered into by the Missouri Highway and Transportation Commission (hereinafter, "Commission") and City of Jefferson (hereinafter, "Grantee"), pursuant to the terms of 5309 Capital Assistance Grant Agreement between these said parties executed oy the Grantee on January 14, 1997, and by the Commission on January 7, 1997. WITNESSETH: WHEREAS, the parties previously entered into a 5309 Capital Assistance Grant Agreement (hereinafter referred to as the "Agreement"). This Agreement provided financial assistance to the Grantee for providing transportation services in the form of a grant of funds made available to the Commission under Chapter 53 of title 49 U.S.C. WHEREAS, the parties to the Agreement have additionally agreed to t terms contained in the formally amend this Agreement and to be bound by he e s � previous Agreement. ! WHEREAS, in this First Amendment to the Agreement, the Commission agrees to provide the Grantee with additional financial assistance for the Grantee's general public transportation services. i. NOW,THEREFORE, it is agreed that the said Agreement shall be amended as follows: (1) CAPITAL COSTS: Paragraph 1(D) of the Agreement is amended to increase the federal share reimbursement to the Grantee for net capital costs to an amount not to exceed the sum of Thirty-nine Thousand Nine Hundred Forty- Seven ($39,947). These capital costs are estimated to be the amount appearing in the Grantee's capital project budget as set forth in the attached Appendix A. (2) ALL TERMS OF THE AGREEMENT TO REMAIN EFFECTIVE: The parties agree that all other terms of the Agreement executed by the parties on January 14, 1997, to remain effective between the parties. This agreement provides federal assistance for computer equipment and a bus hotly on van Chases vehicle I Qhe equipped with a wheelchair lift. bus will be purchased by MoDOT and delivered to the City. The City would like to add a destination sign and automatic retracting seat belts to the bus. The bus will be;used for paratransi, fixed route and park and ride transportation and the sign is needed to idenify the service and routing being provided. The automatic retracting:seat belts are being requested to eliminate a safety hazard caused by seat belts falling into the bus isle. <i The City received a quote from DIAMOND COACH CORP. in the amount of $700.00'for the destination sign and $200.00 for the seat belts. WHEREAS, in this first Amendment to the Agreement, the Commission agrees to - provide the Grantee with additional financial assistance for the Grantee's general public transportation services. �. NOW, THEREFORE, it is agreed that the said Agreement shall be amended as l i follows: (D) (1) CAPITAL, COSTS: Paragraph) of the Agreement is amended to increase the federal share reimbursement to the Grantee for net capital costs to an amount not to exceed the sum of Fifty thousand, seven hundred ninety-five, eighty-three (50,795.83).
