AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND
DISCONTINUING THE RIGHT-OF-WAY FOR A PORTION OF LEXINGTON DRIVE EAST
OF ROLLING HILLS DRIVE IN NEUTZLER'S EARLY AMERICAN SUBDIVISION, j
SECTION ONE. !`
WHEREAS,it has been shown to the Council of the City of Jefferson, Missouri,that I `
the owners of land adjacent to and abutting upon the right-of--way for a portion of Lexington
Drive east of Rolling Hills Drive in Neutzler's Early American Subdivision, Section One, in I
the City, have petitioned the City Council to vacate a right-of-way; and
WHEREAS, it has further been shown that it would not inconvenience the public or
the citizens of the City to discontinue a portion of the right-of-way of for public use as
described in Section 1 of this Ordinance; and
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI,AS FOLLOWS:
Section 1. The Council of the City of Jefferson, Missouri, hereby declares it
necessary, reasonable and proper to discontinue as a right-of-way a portion of and forever
vacate the following described right-of-way in said City:
Part of the sixty (60)foot wide Lexington Drive right-of-way that is located
east of Rolling Hills Road, north of Lot 82 of Neutzler's Early American t
Subdivision,Section 1,as per plat of record in Plat Book 10, Page 40,of the
Cole County Recorder's Office, south of Lot 87 of said Neutzler's Early
American Subdivision, Section 1, and south of Lot 2 of Rolling Hills
Subdivision, Section 1, as per plat of record in Plat Book 8, Page 7, of the
Cole County Recorder's Office, all in the Northwest Quarter of Section 23,
Township 44 North, Range 12 West, in the County of Cole, City of Jefferson,
State of Missouri; being more particularly described as follows:
BEGINNING at the most northerly corner of said Lot 82 of said Neutzler's
Early American Subdivision, Section One; thence southwesterly along the
northwesterly line of said Lot 82 on a curve to the right having a radius of
212.67 feet, an arc distance of 28.99 feet(Chord Bea ring = S58 055'55"W,
Chord 28.97 feet);thence continuing southwesterly along said northwesterly
line on a bearing of S62°49'49"W, 125.00 feet to the most westerly corner
thereof, said corner also being on the easterly line of Rolling Hills Drive;
thence N38 034'09"W along said easterly line, 11.67 feet;thence continuing
northerly along said easterly line on a curve to the right having a radius of

270.00 feet, an arc distance of 48.92 feet(Chord Bearing = N33°22'45"W,
Chord=48.85 feet)to the southwesterly corner of Lot 2 of said Rolling Hills
Subdivision, Section 1; thence leaving the easterly line of said Rolling Hills
„ Drive on a bearing of N62 04949"E, 109.44 feet to the southeasterly corner
of said Lot 2, said corner also being the southwesterly corner of Lot 87 of
said Neutzler's Early American Subdivision, Section 1; thence continuing
N62 049'49"E along the southerly line of said Lot 87, 23.15 feet; thence
continuing northeasterly along said southerly line on a curve to the left having
a radius of 152.67 feet, an arc distance of 56.92 feet (Chord Bearing =
N52°09'11"E, Chord = 56.59 feet); thence leaving said southerly line in a
southerly direction on a curve to the left having a radius of 50.00 feet,an arc
distance of 82.62 feet(Chord Bearing=S05 052'15"E,Chord=73.54 feet)to
the POINT OF BEGINNING.
Containing in all, 0.218 acres.
Section 2. The statutory right of reversion in the owners of the abutting property is ?
hereby confirmed, as is provided by the laws of the State of Missouri, and the Mayor and
the Clerk of the City are hereby authorized to execute all necessary instruments required
to confirm the reversionary rights of the owners of property abutting on the area vacated,
as described in Section 1 of this ordinance, in the right-of-way vacated.
Section 3. This Ordinance shall take effect and be in full force from and after its
