ORDINANCE NO. 11162
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , CHANGING,
AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE
CITY OF JEFFERSON, BY REZONING THE PROPERTY AT 3605 COUNTRY CLUB
DRIVE FROM C-1 , NEIGHBORHOOD COMMERCIAL, TO C-2 , GENERAL
COMMERCIAL.
WHEREAS, IT APPEARS THAT THE PROCEDURES SET FORTH IN THE ZONING
CODE RELATING TO ZONING HAVE IN ALL MATTERS BEEN COMPLIED WITH.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
SECTION 1. The following described real estate is rezoned
from C-1 , Neighborhood Commercial, to C-2 , General Commercial:
Part of the northeast quarter of the northwest quarter
of Section 9, Township 44 North, Range 12 West, in the
City of Jefferson, Missouri, more particularly
described as follows :

IV From the northeast corner of the west half of the
northwest quarter of the northeast quarter of said
Section 9; thence S 6° 28' 25" E, along the east line
of the west half of the northwest quarter of the
northeast quarter of said Section 9, 863.70 feet to the
southerly line of Country Club Drive (old U.S. Route
50 ) ; thence S 76° 05' 14" W, along said southerly line,
1312 .64 feet , to the northwesterly corner of a tract
leased to Hardee' s Food Systems, Inc. as shown by
Memorandum of Lease of record in Book 263, Page 414 ,
Cole County Recorder' s Office , and the beginning point
of this description; thence continuing S 760 05' 14" W,
along said southerly line of Country Club Drive, 120
feet , to the northeasterly corner of a tract conveyed
to Capital City Telephone Company, by deed of record in
Book 206, Page 630, Cole County Recorder' s Office;
thence S 50 01 ' 52" E, along the easterly line of said
tract , 87 . 12 feet , to the northerly right-of-way line
of U.S. Route 50; thence along said northerly line , N
890 39 ' 51" E, 51 .80 feet; thence N 730 30' 06" E,
along said northerly line , 68. 35 feet , to the
southwesterly corner of the aforesaid tract leased to
Hardee' s Food Systems , Inc. ; thence N 50 01 ' 52" W,
along the westerly line thereof, 96.22 feet to the
beginning point of this description.

SECTION 2 . This ordinance shall be in full force and effect
from and after its passage and approval.

REZONING STAFF REPORT
RE: A request filed by Dan Gordon to rezone the property at
3605 Country Club Drive from C-1 , Neighborhood
Commercial, to C-2 , General Commercial.
A new office building is on the property at 3605 Country
Club Drive. It is located between U.S. 50 West and Country Club
Drive and is across the street from Capital Mall.
Central Missouri Broadcasting, Inc. desires to use the
building for the studios of KTXY and KLIK. They also want to
erect a 120' free-standing tower adjacent to the building. A
radio studio with a tower requires C-2 , General Commercial,
zoning.
At its regular meeting of August 11, 1988, the Planning and
Zoning Commission voted unanimously to recommend this request be
approved. The proposed use is in accordance with the
Comprehensive Plan. On September 1:3, 1988, the Board of
Adjustment approved a request for a height variance for the
proposed 120 foot tower. No one appeared in opposition to the
rezoning request nor the height variance request.
