AN ORDINANCE OF THE CITY OF RICHLAND HILLS,
TEXAS RESTRUCTING THE MEMBERSHIP ON THE
KEEP RICHLAND HILLS BEAUTIFUL COMMISSION;
PROVIDING THAT THIS ORDINANCE SHALL BE
CUMULATIVE OF ALL ORDINANCES; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Richland Hills is a home rule city acting under its
charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas
Constitution and Chapter 9 of the Local Government Code; and
WHEREAS, the City Council of the City of Richland Hills has previously
authorized the creation of a Keep Richland Hills Beautiful Commission, and provided
that said board shall be composed of ten members; and
• WHEREAS, upon recommendation of the chairperson of the Commission,
the City Council has determined that 'the Commission's membership shauld be
restructured to include the following: five at-large members, with a minimum of three
Richland Hills residents and two business representatives that may or may not live in
Richland Hills; two youth members, age 15 to 19 years of age; and three alternate
members, one of whom may be a business representative;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF RICHLAND HILLS, TEXAS:
SECTION 1.
Section 10-182 of Article VI of the Chapter 10 of the Richland Hills City Code is
hereby amended,to provide as follows:
Sec. 10-182. Composition, appointments and terms of members.
(a) The Keep Richland Hills Beautiful Commission shall be composed of seven
members, all of which shall be appointed by the City Council at large. Two of
• the seven members shall be youth members who shall be between the ages
of fifteen (15) and nineteen (19) years of age when appointed. The youth
• members shall be residents of the City. At least three of the remaining five
members shall also be residents of the City. The remaining two members
may but need not be residents of the City, but if not residents of the City, they
must be the owner, operator, or employee of a business located in the City.
The Council may also appoint up to three alternate members. At least two of
the alternate members shall be residents of the City. The remaining alternate
member may but need not be a resident of the City, but if not a resident of the
City, such alternate member must be the owner, operator, or employee of a
business located in the City. In the event a member of the Commission is
absent from any meeting, the alternate member who has served as an
alternate for the longest continuous period and who is present at the meeting
shall be entitled to participate and vote in the absent member's stead.
(b) All the members and alternate members of the Commission shall serve at the
will of the City Council, but unless removed by the Council, each member and
alternate member shall serve for a term of two years. Any councilmember
may nominate any person to membership or alternate membership on the
Commission. All nominations shall be considered approved unless any
councilmember objects, in which case a majority vote of the City Council
shall be necessary for such person to be appointed.
(c) The City staff representative to the Commission shall be the Director of Public
• Works or, with the approval of the City Manager, the Director's designee.
SECTION 2.
Section 10-185 of Article VI of the Chapter 10 of the Richland Hills City Code is
hereby amended,to provide as follows:
Sec. 10-185. Meetings, rules of procedure and quorum.
The Keep Richland Hills Beautiful Commission shall hold meetings
regularly at least once each month at a time and place designated by the
majority vote of the members. The Keep Richland Hills Beautiful
Commission shall, in matters of procedure, be governed by Robert's Rules
of Order, Newly Revised, unless it adopts such other or additional rules of
procedure as it may deem necessary. A majority of the currently appointed
regular members shall constitute a quorum for the transaction of business.
SECTION 3.
This ordinance shall be cumulative of all provisions of ordinances and of the Code of
Ordinances of the City of Richland Hills, Texas, as amended, except where the
• provisions of this ordinance are in direct conflict with fihe provisions of such ordinances
• and such Code, in which event the conflicting provisions of such ordinances and such
Code are hereby repealed.
SECTION 4.
It is hereby declared to be the intention of the City Council that the phrases, clauses,
sentences, paragraphs, and sections of this ordinance are severable, and if any phrase,
clause sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences, paragraphs and sections of this ordinance, since the same would have been
enacted by the City Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 5.
This ordinance shall be in full force and effect from and after its passage, and it is so
ordained.
