AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY REZONING THREE PARCELS OF LAND IN SECTION 9, TOWNSHIP 44 NORTH, RANGE 11 WEST, ALL IN CALLAWAY COUNTY, MISSOURI , FROM RU, RURAL, TO M-1, LIGHT INDUSTRIAL. WHEREAS, IT APPEARS THAT THE PROCEDURES SET FORTH IN THE ZONING CODE RELATING TO ZONING HAVE IN ALL MATTERS BEEN COMPLIED WITH. NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI , AS FOLLOWS: SECTION 1. The following described real estate is rezoned from RU, Rural, to M-1, Light Industrial: Three parcels of land in Section 9, Township 44 North, Range 11 West, all in Callaway County, Missouri, with each parcel being described as follows: a. A parcel of land bounded on the south by the corporate limits of Cedar City, on the east by an existing M-1 Zoning ® District boundary line as shown in the Jefferson City Zoning Atlas, on the north by Highway U.S. 63, and on the west by Turkey Creek; b. A parcel of land which is bounded on the west by Callaway County Road 204 , on the south by Highway U.S. 63 , on the east by an existing M-1 Zoning District boundary line as shown in the Jefferson City Zoning Atlas , and on the north by the north line of said Section 9; C. A .23 acre parcel at the northwest corner of Highway U.S. 63 and Callaway County Road 204 . SECTION 2 . This ordinance shall be in full force and effect from and after its passage and approval. Gordon to rezone three parcels of land in the Callaway County portion of Jefferson City from RU, Rural, to M-1, Light Industrial. These three parcels are located on both sides of new U.S. Highway 63. Turkey Creek, which is the Jefferson City corporate limits, is to the west, Cedar City is to the south, and an existing M-1 District is to the east. An existing RU District is to the north. The land is in the Flood Plain of the Missouri River, is relatively flat, and is currently used for agricultural purposes. The M-1 boundary line to the east of the rezoning request was the city limits following a 1971 annexation. In 1971 , little concern was given to the flood plain and the bottom lands of the Missouri River were considered to be a prime location for new industry. The applicant ' s land was taken into the City in 1976. By that time , there was a general awareness of a need for f loodplain protection and an RU zoning designation was the best type of flood plain protection the City could offer at that time. In 1981 , the City obtained good mapping which showed the boundaries ® and elevations of the 100 Year Flood Plains throughout the City. In that same year, the City adopted a rather stringent Flood Hazard Control Ordinance. This ordinance was updated in 1987. Under the City' s current Flood Hazard Regulations , a new building erected on the applicant ' s land would need to be f loodproofed or elevated from 6 to 8 feet above the existing ground level. The Comprehensive Plan designates the applicant' s land as Rural. At its meeting of October 13 , 1988, the Jefferson City Planning and Zoning Commission voted to recommend that the land be rezoned to M-1 with reasons for deviating from the Comprehensive Plan being: 1. The reason for the original RU zoning does not now exist since the City is currently enforcing a good Flood Hazard Ordinance and Map. 2 . The tract is adjacent to an existing M-1 District .
