AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELINQUISHING A
CERTAIN EASEMENT FOR UTILITY PURPOSES OVER LAND LOCATED AT
MERCHANTS DRIVE AND HIGHWAY 179, IN JEFFERSON CITY, MISSOURI.
WHEREAS, by an easement per plat of record Plat Book 11, Page
27, of the Records of Cole County, Missouri, a utility easement was
granted to the City of Jefferson, a Municipal Corporation, to
excavate within, install, construct, maintain and repair structures
for the routing and conveyance of utilities in, under and through
the lots, tracts or parcels of land described in Section 1;
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS FOLLOWS:
Section 1. The Council finds that the following described
easement is surplus property of the City and is no longer needed
for any public purpose:
Part of Lot No. 31 of Bax's Commercial Property, Section 2,
e in the City of Jefferson, Missouri, per plat of record in Plat
Book 11, Page 27, Cole County Recorder's Office, and more
particularly described as a strip of land ten feet wide, lying
west of and adjacent to the following described line:
From the southeast corner of said Lot No. 31; thence N
05°17 '30" W, along the East Line of Lot No. 31, 16.07 feet to
the point of beginning for said line; thence continuing N
05°17 '30" W, along the East Line of Lot No. 31, 231.83 feet
to the point of termination.
Section 2. The easement described in Section 1 is hereby
relinquished, and the City does hereby release and abandon whatever
interest it has in the easement.
Section 3. The Mayor and City Clerk are hereby authorized to
execute any necessary legal document relinquishing all of the
City's interest in the tract of ground described in Section 1.
S section 4. This Ordinance shall be in full force and effect
from and after its passage and approval.
