AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , CHANGING,
AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE
CITY OF JEFFERSON, BY REZONING LAND IN THE SOUTHEAST QUARTER OF
THE NORTHWEST QUARTER OF SECTION 12 , TOWNSHIP 44 NORTH, RANGE 12
WEST, FROM RS-3 (SINGLE FAMILY) TO C-2 ( GENERAL COMMERCIAL) AND
RS-1 ( SINGLE FAMILY) AND LAND IN THE SOUTHEAST QUARTER OF THE
NORTHWEST QUARTER AND THE SOUTHWEST QUARTER OF THE NORTHEAST
QUARTER OF SECTION 12 , TOWNSHIP 44 NORTH, RANGE 12 WEST, FROM RD
(TWO FAMILY DWELLING) TO RS-1 (SINGLE FAMILY) .
WHEREAS, IT APPEARS THAT THE PROCEDURES SET FORTH IN THE ZONING
CODE RELATING TO ZONING HAVE IN ALL MATTERS BEEN COMPLIED WITH.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI , AS FOLLOWS:
SECTION 1 . The following described real estate is rezoned
from RS-3 (single family ) to C-2 ( general commercial) :
Part of the southeast quarter of the northwest quarter
of Section 12 , Township 44 North, Range 12 West, in the
County of Cole, City of Jefferson, Missouri, and being
more particularly described as follows:
From a point on the west line of Lot No. 8 of Sunny
Side Place, per plat of record in Plat Book 3 , Page 52 ,
Cole County Recorder's Office, lying 23.47 feet south
of the northwest corner of said Lot No. 8 , and said
point being the northeast corner of a tract of land as
described in Book 136 , Page 297 , Cole County Recorder' s
Office; thence N 660 56 ' 41" W, 383 .00 feet to the
point of beginning for this description; thence N 69°
25 ' 30" W, 67 . 30 feet; thence N 650 38 ' 30" W, 59. 11

West, in the County of Cole, City of Jefferson,
Missouri, and being more particularly described as
follows:
Beginning at a point on the west line of Lot No. 8 of

feet south of the northwest corner of said Lot No. 8 ,

REZONING PUBLIC HEARING
RE: A request filed by Angeline Busch to rezone:
a. A 3.5 acre tract (more or less ) located
approximately 110 ' east of Rax Court,
approximately 500 ' west of Waverly Street and 250 '
to 300 ' south of St. Mary' s Blvd. from RS-3
(single family) to C-2 ( general commercial) ,
and
b. A tract north of the above described 3 . 5 acre
tract and south of St. Mary's Blvd. and a
connected tract east of the above described 3.5
acre tract and west of Waverly Street from RS-3
(single family) and RD ( two family dwelling) to
RS-1 (single family) .
The property immediately adjacent to Jefferson Plaza is not,
in the owner's opinion, suitable for residential development.
The owner is therefore requesting commercial zoning for the 3.5
acres closest to the existing commercial development. The
applicant is certain that the owners of existing residences along
St. Mary's Blvd. and Waverly Street do not want commercial zoning
immediately adjacent to their rear property lines and therefore
is requesting a down-zoning of RS-3 and RD properties to RS-1.
No residential development is contemplated.
The desired use for the proposed commercial zoning is
unknown. Most of the existing establishments located along and
adjacent to Missouri Blvd. are representative of the types of
businesses which may locate in a C-2 zoning district.
The only access to the 3.5 acres is to be from Missouri
Blvd. This access is located immediately west of Jefferson Plaza
(parcel 43 on location map) .
Staff interpreted the Future Land Use Plan of the
Comprehensive Plan to show:
1. The southerly three-fourths of the requested commercial
zoning to be in accordance with the Comprehensive Plan.
2. The residential rezoning request to be in accordance
with the Plan.

A group of interested citizens from Waverly Street and St.
Mary's Blvd. were in attendance. One spoke in opposition with
his opposition being based on his fear that there would be a
drive connecting St. Mary's Blvd. with the proposed commercial
area.
Staff recommended that the requests be approved for the
following reasons:
1. Staff agrees with the owner's opinion that the land
immediately adjacent to Jefferson Plaza is not suitable
for single family dwellings.
2. The requests are generally consistant with the
Comprehensive Plan.
3 . The requested C-2 zoning is adjacent to an existing C-2
district.
® 4 . The rezonings would not increase traffic volumes on St.
Mary's Blvd. or Waverly Street.
5. The owner is leaving a buffer area between the proposed
commercial area and the existing residences.
At its regular meeting of December 8 , 1988 , the Jefferson
City Planning and Zoning Commission voted to recommend the
request be approved with six voting in favor of part a. of the
request and three voting against. Part b. of the request was
approved unanimously.
