AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH CEDAR CITY FOR
THE PROVISION OF FIRE PROTECTION SERVICES IN CEDAR CITY DURING THE
INTERIM PERIOD BEFORE THE EFFECTIVE DATE OF CONSOLIDATION BY THE
FIRE DEPARTMENT OF THE CITY OF JEFFERSON, MISSOURI.
BE IT .ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS FOLLOWS:
Section 1. The Mayor and City Clerk are hereby authorized and
directed to execute an agreement with Cedar City, Missouri, for the
provision of fire protection services in Cedar City during the
interim period before the effective date of consolidation by the
Fire Department of the City of Jefferson, Missouri.
Section 2. The agreement shall be substantially the same in
form and content as that agreement attached hereto as Exhibit A.
Section 3 . This Ordinance shall be in full force and effect
from and after the date of its passage and approval.

INTRAGOVERNMENTAL FIRE PROTECTION SERVICE AGREEMENT
® This agreement made and entered on the J / day of
February, 1989, between the City of Jefferson, Missouri, a
municipal corporation, and Cedar City, Missouri, a municipal
corporation.
WHEREAS, the voters of the City of Jefferson, Missouri, and
the voters of Cedar City, Missouri, approved the issue of
consolidation that was placed before them in the February 7, 1989,
election; and
WHEREAS, the effective date of the consolidation is July 1,
1989; and
WHEREAS, Cedar City has requested that the City of Jefferson
provide fire protection to its residents during this interim period
of time; and
WHEREAS, it is in the best interest of both the City of
Jefferson, Missouri, and Cedar City to provide such protection.
NOW, THEREFORE, It is agreed between the parties as follows:
1. Scope of Services. The city will furnish fire protection
service to Cedar City as it now furnishes to any area within the
City of Jefferson, including rescue service. For the purposes of
this agreement the services to be rendered to Cedar City are as
though Cedar City and its buildings and property were located
within the city limits of the City of Jefferson, Missouri.
2. Restrictions of Service. The fire protection service is
subject to prior fire calls involving property located within the
City of Jefferson. It shall not be a violation of this agreement
if, in the judgment of the officer in charge of the city' s fire
department, a failure to respond to a fire call would jeopardize
fire protection to the City of Jefferson. The City of Jefferson
shall not be responsible for any loss which may result from failure
to respond promptly or failure to respond to any call for fire
protection service from the company.
3 . Indemnity. The city is not responsible for any claims because
of injuries to the public or damage to the property which occur
while the city' s fire department is engaged in answering a fire
• call or working at or returning from a fire in response to any call
from the company under the terms of this agreement. Cedar City
agrees to indemnify the city for any judgment rendered against it
or sums paid out by it in payment of any claims.
4 . Terms of the Contract. For the period beginning at 8 : 00 p.m.
February 21, 1989, or after execution of this agreement by both .
cities, whichever is later, and expiring on midnight, June 30,
1989, the City of Jefferson, Missouri, shall furnish all fire
fighting, fire prevention, and rescue service, utilizing regular
fire personnel employed by the city and fire fighting apparatus and
equipment owned by the City of Jefferson, all as the fire chief of
the City of Jefferson, may determine, to Cedar City, Missouri.
5. Payment Schedule. While this contract is in effect Cedar City
agrees to pay to the City of Jefferson, Missouri, as payment for
services rendered the sum of $11, 500.00, payment to be made as
follows:
(A) $11, 500. 00 upon the execution of this agreement
6. Authority. The fire chief of the City of Jefferson, shall
have the exclusive right to prescribe the manner and method of
giving the alarm for fire or other emergency service in the
® territory of Cedar City, Missouri.
7. Officer in Charge. The fire chief or other officers
designated by the City of Jefferson shall, immediately upon
arriving at the scene of any alarm or emergency, have the exclusive
authority to direct the fire fighting and/or fire prevention
activities and emergency operations, and any officers or persons
appointed by Cedar City shall be subject to the orders of the fire
chief.
8. Regulations. All fire fighting and fire prevention activities
carried on under the provisions of this contract shall be in
accordance with the regulations and ordinances of the City of
Jefferson.
9. Expenses Connected with contract. All expenses of maintaining
equipment, apparatus, salaries, insurance premiums, and other
expenses connected with the services to be performed by the City
of Jefferson, Missouri, under this agreement are at the City of
Jefferson's expense.
• 10. No Fire Code Enforcement. No routine enforcement of the fire
code for Cedar City shall be in effect during the term of this
contract, except as a result of fire suppression.
11. 911 Service for Fire. Request for emergency services through
911 shall be available upon the execution of this contract by both
parties.
12. House Numbering. Cedar City agrees to renumber any and all
houses as may be necessary to assist in the implementation of this
contract.
13 . Streets. Cedar City agrees to rename any and all streets that
are duplicate names of streets already existing in the City of
Jefferson, Missouri.
14. Equipment Transfer. The City of Jefferson shall receive as
additional compensation any and all equipment currently owned by
Cedar City and shall be responsible for its maintenance and upkeep.
The City of Jefferson shall also be responsible for ensuring any
equipment that is on loan to Cedar City from another government
entity shall be returned to the same. Cedar City agrees to assist
in the collection and retention of any and all records and
equipment necessary to accomplish the orderly transfer of
responsibility.
15. Publicity. Both parties shall be responsible for informing
the public of the services offered in this contract.
In witness of this agreement, the parties have executed these
articles by their respective officers and have affixed their
respective corporate seals.
These articles have been executed on behalf of the City of
Jefferson, Missouri, pursuant to their adoption by an ordinance of
the City Council on February 20, 1989.
These articles have been executed on behalf of Cedar City,
Missouri, pursuant to their adoption by a resolution of the Board
of Aldermen on February 21, 1989.
