• ORDINANCE NO.1026-05
AN ORDINANCE AMENDING CITY OF RICHLAND HILLS ORDINANCE NO. 993-04
AND THE FISCAL YEAR 2004-05 BUDGET FOR THE CITY OF RICHLAND HILLS,
TEXAS, ADOPTED THEREBY; PROVIDING A SEVERABILITY CLAUSE; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Richland Hills, Texas, adopted
Ordinance No. 993-04 on September 14, 2004, approving and adopting a municipal
budget for the City of Richland Hills, Texas, for fiscal year 2004-05 and
WHEREAS, changed conditions resulted in the adoption of Ordinance No. 1003-
05 on January 25; Ordinance No. 1006-05 on February 8, 2005; Ordinance No. 1012-
05 on April 26, 2005; Ordinance No. 1016-05 on June 14, 2005 and Ordinance No.
1021-05 on July 26, 2005 amending the budget adopted by Ordinance No. 993-04; and
WHEREAS, changed conditions and circumstances, which could not have been
foreseen through the use of reasonably diligent thought and attention, have
necessitated a certain amendment to Ordinance No. 993-04 and the budget adopted
thereby; and
• WHEREAS, a public hearing on the following amendment to the fiscal year
2004-05 budget contemplated hereby has been held as required by law.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF RICHLAND HILLS, TEXAS:
That Section III said Ordinance No. 993-04 as amended be amended to increase
the enterprise fund appropriation from $2,817,207 to $3,093,829 with such increase
allocated and appropriated as follows:
$276,622 such sum the surplus from the 2002 Certificates of Obligation Issue for
transfer to the 2002 Certificates of Obligation Interest and Sinking Fund as required by
said issuance ordinance for repayment of debt.

That Section VIII of said Ordinance No. 993-04 as amended be amended
appropriating $68,481 out of the 1998 General Obligations Interest and Sinking Fund
for the repayment of general long-term debt principal and interest.

That Section IX of said Ordinance No. 993-04 as amended be amended
appropriating $187,249 out of the 1998 Certificate of Obligations Expense Fund for
capital improvements to the wastewater works.
IV.
That Section XVII of said Ordinance No. 993-04 as amended be amended
appropriating $116,666 out of the Homeland Security Grant Fund to procure equipment
and implement program to protect city facilities from terrorism.
V.
That Section XXI-A of said of said Ordinance No. 993-04 as amended be
amended appropriating $20,986 out of the Municipal Court Technology Fund for the
purpose of acquiring computers, software and other technological equipment.
VI.
That Section XXI-B be created in said Ordinance No. 993-04 as amended be
• amended appropriating $5,441 out of the Library Grants TIFB/Lone Star Fund for the
purpose of purchasing equipment and materials for the Library.
VII.
That Section XXI-C be created in said Ordinance 993-04 as amended be
amended appropriating $10,000 from the Kate Baker Park Fund for the purpose of
providing architectural design services for Kate Baker Park Replacement Building.
VIII.
That Section XXI-D be created in said Ordinance 993-04 as amended be
amended appropriating $19,992 from the Richland Hills Rocks Festival Fund for the
purpose of conducting special event to promote economic development.
IX.
That Section XXI-E be created in said Ordinance 993-04 as amended be
amended appropriating $4,327 from the Gateway STEP Fund for the purpose of
installing electrical service at monument site on Baker Boulevard.

• That Section XXI-F be created in said Ordinance 993-04 as amended be
annended appropriating $5,326 from the Oil and Gas Lease Fund for the purpose of
expending legal fees to research, prepare and execute lease documents.
XI.
Severablility Clause. That it is hereby declared to the intention of the City
Council that the sections, paragraphs, sentences, clauses and phrases of this
ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of
this of this ordinance shall be declared invalid or unconstitutional by the valid judgment
or decree of any court of competent jurisdiction, such invalidity or unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted by the City Council
without the incorporation in this ordinance of any such invalid or unconstitutional
phrase, clause, sentence, paragraph or section.
XII.
Saving Clause. That said Ordinance 993-04 of the City of Richland Hills, Texas,
shall remain in full force and effect, save and except as amended by this ordinance.
XIII.
• Effective Date. This ordinance shall be in full force and effect from and after its
passage.
PRESENTED, GIVEN FIRST READING AND APPROVED at a regular meeting
of the Richland Hills City Council on the 27h day of September, 2005, by a vote of
